| 8 | with children; requiring that each state or governmental |
| 9 | subdivision search the records of sexual predators and |
| 10 | sexual offenders maintained by the Department of Law |
| 11 | Enforcement before appointing or employing a person to |
| 12 | work or volunteer at a park, playground, day care center, |
| 13 | or other place where children regularly congregate; |
| 14 | authorizing the use of the department's Internet site to |
| 15 | conduct the search; providing an exception; providing an |
| 16 | effective date. |

| 18 | Be It Enacted by the Legislature of the State of Florida: |
| 19 |

| 20 | Section 1. Search of registration information regarding |
| 21 | sexual predators and sexual offenders required prior to |
| 22 | appointment or employment.--A state agency or governmental |
| 23 | subdivision, prior to making any decision to appoint or employ a |
| 24 | person to work, whether for compensation or as a volunteer, at |
| 25 | any park, playground, day care center, or other place where |
| 26 | children regularly congregate, must conduct a search of that |
| 27 | person's name or other identifying information against the |
| 28 | registration information regarding sexual predators and sexual |
| 29 | offenders maintained by the Department of Law Enforcement under |
| 30 | section 943.043, Florida Statutes. The agency or governmental |
| 31 | subdivision may conduct the search using the Internet site |
| 32 | maintained by the Department of Law Enforcement. This section |
| 33 | does not apply to those positions or appointments within a state |
| 34 | agency or governmental subdivision for which a state and |
| 35 | national criminal history background check is conducted. |
| 36 | Section 2. This act shall take effect upon becoming a law. |
