A bill to be entitled
2An act relating to infant eye care; amending s. 383.04,
3F.S.; requiring certain eye examinations for all infants
4born in hospitals in the state; revising certain
5applicability provisions; reenacting s. 383.07, F.S.,
6relating to a penalty; amending ss. 627.6416 and 641.31,
7F.S.; providing that coverage for children under health
8insurance policies and health maintenance organization
9contracts include certain eye examinations for infants and
10children; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 383.04, Florida Statutes, is amended to
15read:
16     383.04  Prophylactic required for eyes of infants.--Every
17physician, midwife, or other person in attendance at the birth
18of a child in the state is required to instill or have instilled
19into the eyes of the baby within 1 hour after birth an effective
20prophylactic recommended by the Committee on Infectious Diseases
21of the American Academy of Pediatrics for the prevention of
22neonatal ophthalmia. In addition, every baby born in a hospital
23in the state shall receive, prior to being discharged from the
24hospital, an eye examination using an ophthalmoscope and
25dilation of the pupils for detection of pediatric congenital and
26ocular abnormalities and developmental abnormalities. The
27provisions relating to the examination using an ophthalmoscope
28are not subject to the provisions of s. 383.07. This section
29does not apply to cases where the parents file with the
30physician, midwife, or other person in attendance at the birth
31of a child written objections on account of religious beliefs
32contrary to the use of drugs. In such case the physician,
33midwife, or other person in attendance shall maintain a record
34that such measures were or were not employed and attach thereto
35any written objection.
36     Section 2.  Section 383.07, Florida Statutes, is reenacted
37to read:
38     383.07  Penalty for violation.--Any person who fails to
39comply with the provisions of ss. 383.04-383.06 shall be guilty
40of a misdemeanor of the second degree, punishable as provided in
41s. 775.083.
42     Section 3.  Paragraph (a) of subsection (2) of section
43627.6416, Florida Statutes, is amended to read:
44     627.6416  Coverage for child health supervision services.--
45     (2)  As used in this section, the term "child health
46supervision services" means physician-delivered or physician-
47supervised services that include, at a minimum, services
48delivered at the intervals and scope stated in this section.
49     (a)  Child health supervision services must include
50periodic visits which shall include a history, a physical
51examination, a developmental assessment and anticipatory
52guidance, and appropriate immunizations and laboratory tests,
53and eye examinations at birth, at 6 to 8 weeks of age, and at 6
54to 9 months of age, using an ophthalmoscope and dilation of the
55pupils for detection of pediatric congenital and ocular
56abnormalities and developmental abnormalities. Such services and
57periodic visits shall be provided in accordance with prevailing
58medical standards consistent with the Recommendations for
59Preventive Pediatric Health Care of the American Academy of
60Pediatrics.
61     Section 4.  Paragraph (b) of subsection (30) of section
62641.31, Florida Statutes, is amended to read:
63     641.31  Health maintenance contracts.--

65     (b)  As used in this subsection, the term "child health
66supervision services" means physician-delivered or physician-
67supervised services that include, at a minimum, services
68delivered at the intervals and scope stated in this subsection.
69     1.  Child health supervision services must include periodic
70visits which shall include a history, a physical examination, a

80Pediatrics.
81     2.  Minimum benefits may be limited to one visit payable to
82one provider for all of the services provided at each visit
83cited in this subsection.
84     Section 5.  This act shall take effect July 1, 2004.
