A bill to be entitled
2An act relating to immunizations; amending s. 400.426,
3F.S.; requiring assisted living facilities to implement a
4program to offer immunizations to residents against
5influenza viruses; amending s. 1003.22, F.S.; requiring
6each district school board and the governing authority of
7each private school to provide information concerning
8meningococcal disease and its vaccine to parents;
9requiring the Department of Health to adopt rules
10specifying the age or grade level of students for whom
11such information will be provided; requiring each district
12school board and the governing authority of each private
13school to determine the means and method for the provision
14of information regarding meningococcal disease to parents;
15providing an effective date.

17Be It Enacted by the Legislature of the State of Florida:
18
19     Section 1.  Subsection (13) is added to section 400.426,
20Florida Statutes, to read:
21     400.426  Appropriateness of placements; examinations of
22residents.--
23     (13)  Between October 1, or earlier if the vaccination is
24available, and February 1 of each year, subject to the
25availability of an adequate supply of the necessary vaccine,
26each assisted living facility licensed pursuant to this part
27shall implement a program to offer immunizations against
28influenza viruses to all residents who are age 65 or older, in
29accordance with the recommendations of the Advisory Committee on
30Immunization Practices of the United States Centers for Disease
31Control and Prevention and subject to the clinical judgment of
32the responsible practitioner.
33     Section 2.  Subsection (10) of section 1003.22, Florida
34Statutes, is amended to read:
35     1003.22  School-entry health examinations; immunization
36against communicable diseases; exemptions; duties of Department
37of Health.--
38     (10)  Each district school board and the governing
39authority of each private school shall:
40     (a)  Refuse admittance to any child otherwise entitled to
41admittance to kindergarten, or any other initial entrance into a
42Florida public or private school, who is not in compliance with
43the provisions of subsection (4).
44     (b)  Temporarily exclude from attendance any student who is
45not in compliance with the provisions of subsection (4).
46     (c)  Provide detailed information concerning the causes,
47symptoms, and transmission of meningococcal disease; the risks
48associated with meningococcal disease; and the availability,
49effectiveness, and known contraindications of any required or
50recommended vaccine against meningococcal disease to every
51student's parent, in accordance with the recommended ages of
52students determined by the Department of Health to be
53appropriate for the administration of such vaccine. The
54Department of Health shall adopt rules that specify the age or
55grade level of students for whom such information shall be
56provided, consistent with the recommendations of the Advisory
57Committee on Immunization Practices of the United States Centers
58for Disease Control and Prevention concerning the appropriate
59age for the administration of the vaccine, and shall make
60available information concerning the causes, symptoms, and
61transmission of meningococcal disease; the risks associated with
62meningococcal disease; and the availability, effectiveness, and
63known contraindications of any required or recommended vaccine
64to school districts and the governing authorities of each
65private school. Each district school board and the governing
66authority of each private school shall determine the means and
67methods for the provision of such information to students'
68parents.
69     Section 3.  This act shall take effect July 1, 2005.
