| 6 | An act relating to physical education in the public |
| 7 | schools; amending s. 1003.455, F.S.; requiring each school |
| 8 | district to submit to the Department of Education a copy |
| 9 | of the wellness policy required by federal law; requiring |
| 10 | the department to provide public electronic access to |
| 11 | school district policies; encouraging public input; |
| 12 | specifying content of staff development for physical |
| 13 | education instructors; encouraging each district school |
| 14 | board to evaluate its physical education program and |
| 15 | policy and review certain practices by a specified date; |
| 16 | providing an effective date. |

| 18 | Be It Enacted by the Legislature of the State of Florida: |
| 19 |
|
| 20 | Section 1. Subsections (4), (5), and (6) are added to |
| 21 | section 1003.455, Florida Statutes, to read: |
| 22 | 1003.455 Physical education; assessment.-- |
| 23 | (4) By December 1, 2005, each school district shall submit |
| 24 | to the Department of Education a copy of the wellness policy |
| 25 | required by the Child Nutrition and WIC Reauthorization Act of |
| 26 | 2004. The department shall provide for public electronic access |
| 27 | to the school district policies so they may be reviewed and |
| 28 | shared. School districts are encouraged to regularly solicit |
| 29 | public input regarding their policies on school nutritional |
| 30 | offerings and physical activity/fitness offerings. |
| 31 | (5) Staff development for physical education instructors |
| 32 | must include content related to an integrated curriculum that |
| 33 | supports classroom learning, particularly in the areas of |
| 34 | reading and mathematics, fitness-based instruction, and |
| 35 | connections between movement and learning. |
| 36 | (6) By January 1, 2006, each district school board is |
| 37 | encouraged to: |
| 38 | (a) Evaluate the level of participation of students in the |
| 39 | district school board's physical education program in order to |
| 40 | determine whether the district school board's policy reflects |
| 41 | the local community's expectations and needs. |
| 42 | (b) Ensure that certified physical education teachers are |
| 43 | hired to teach physical education. |
| 44 | (c) Review and determine whether the district school |
| 45 | board's professional development opportunities include best |
| 46 | practices for fitness-related instruction, strategies that |
| 47 | support classroom learning, connections between movement and |
| 48 | learning, and strategies for integrating academic subject |
| 49 | matter, particularly in reading, mathematics, and physical |
| 50 | education. |
| 51 | (d) Review the practice of providing physical fitness |
| 52 | assessments at each grade level in order to provide valid |
| 53 | information to students and parents for improving the quality of |
| 54 | physical education programs and to determine whether its |
| 55 | physical education program is meeting the needs of the community |
| 56 | and parents. |
| 57 | (e) Review the research and best practices regarding how |
| 58 | planned physical movement can foster enhanced learning in |
| 59 | academic subjects. |
| 60 | (f) Review the district school board's adopted physical |
| 61 | education policy in order to ensure that the policy meets the |
| 62 | intent and spirit of the law, applicable rules, and the Sunshine |
| 63 | State Standards. |
| 64 | Section 2. This act shall take effect July 1, 2005. |
