  1                      A bill to be entitled

  2         An act relating to the abandonment of roads;

  3         amending s. 316.006, F.S.; conforming a

  4         cross-reference; transferring and renumbering

  5         s. 316.00825, F.S., relating to a county's

  6         authority to close and abandon roads and

  7         rights-of-way and convey the county's interest

  8         to a homeowners' association; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Paragraph (c) of subsection (3) of section

14  316.006, Florida Statutes, is amended to read:

15         316.006  Jurisdiction.--Jurisdiction to control traffic

16  is vested as follows:

17         (3)  COUNTIES.--

18         (c)  If the governing body of a county abandons the

19  roads and rights-of-way dedicated in a recorded residential

20  subdivision, and simultaneously conveys the county's interest

21  therein to a homeowners' association for the subdivision in

22  the manner prescribed in s. 336.125 s. 316.00825, that

23  county's traffic control jurisdiction over the abandoned and

24  conveyed roads ceases unless the requirements of paragraph (b)

25  are met.

27  Notwithstanding the provisions of subsection (2), each county

28  shall have original jurisdiction to regulate parking, by

29  resolution of the board of county commissioners and the

30  erection of signs conforming to the manual and specifications

31  of the Department of Transportation, in parking areas located

 1  on property owned or leased by the county, whether or not such

 2  areas are located within the boundaries of chartered

 3  municipalities.

 4         Section 2.  Section 316.00825, Florida Statutes, is

 5  transferred and renumbered as section 336.125, Florida

 6  Statutes.

 7         Section 3.  This act shall take effect upon becoming a

 8  law.

13  This CS transfers and renumbers s. 316.00825, F.S., as newly
    created s. 336.125, F.S. The CS also amends s. 316.006, F.S.,
14  to change a statutory reference to conform to the newly
    created s. 336.125, F.S.
