| 4 | Research and Treatment Trust Fund within the Department of | 
| 5 | Health; providing a revenue source for the fund; requiring | 
| 6 | that moneys in the trust fund be used for the disbursement | 
| 7 | of grants by the Florida Cancer Council for certain | 
| 8 | purposes; providing for future review and termination or | 
| 9 | re-creation of the trust fund; providing a contingent | 
| 10 | effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: | 
| 13 | 
 | 
| 14 | Section 1.  Section 381.926, Florida Statutes, is created | 
| 15 | to read: | 
| 16 | 381.926  Cancer Research and Treatment Trust Fund.-- | 
| 17 | (1)  The Cancer Research and Treatment Trust Fund is | 
| 18 | created within the Department of Health. Funds credited to the | 
| 19 | trust fund shall consist of moneys provided by law or otherwise | 
| 20 | appropriated by the Legislature for the purposes prescribed in | 
| 21 | s. 381.921. | 
| 22 | (2)  In accordance with s. 19(f)(2), Art. III of the State | 
| 23 | Constitution, the trust fund shall terminate on July 1, 2009, | 
| 24 | unless terminated sooner. Before its scheduled termination, the | 
| 25 | trust fund shall be reviewed as provided in s. 215.3206. | 
| 26 | Section 2.  This act shall take effect July 1, 2005, if | 
| 27 | House Bill 1233 or similar legislation is enacted in the same | 
| 28 | legislative session or an extension thereof and becomes law or | 
| 29 | if the General Appropriations Act for fiscal year 2005-2006 | 
| 30 | includes funding for the purposes prescribed in s. 381.921, | 
| 31 | Florida Statutes. |
