| 1 | A bill to be entitled |
| 2 | An act relating to Hillsborough County; authorizing the |
| 3 | Division of Alcoholic Beverages and Tobacco of the Florida |
| 4 | Department of Business and Professional Regulation to |
| 5 | issue an alcoholic beverage license to the Arts Council of |
| 6 | Hillsborough County for use within the Tampa Theatre; |
| 7 | providing that the license may be used for special events |
| 8 | only; providing for payment of the license fee by the |
| 9 | council; providing for sale of beverages for consumption |
| 10 | within the theatre; prohibiting sales for consumption off |
| 11 | the premises; providing that purchasers may remove |
| 12 | partially consumed, open containers from the premises; |
| 13 | providing for temporary transfer of the license; providing |
| 14 | an effective date. |

| 16 | Be It Enacted by the Legislature of the State of Florida: |
| 17 |

| 18 | Section 1. Notwithstanding any other provision of law, the |
| 19 | Division of Alcoholic Beverages and Tobacco of the Florida |
| 20 | Department of Business and Professional Regulation is |
| 21 | authorized, upon application, to issue an alcoholic beverage |
| 22 | license in accordance with section 561.17, Florida Statutes, to |
| 23 | the Arts Council of Hillsborough County, hereinafter referred to |
| 24 | as "the council," an independent district in Hillsborough County |
| 25 | located at 1000 N. Ashley Street, Suite 105, Tampa, for use by |
| 26 | the council within the building known as the Tampa Theatre, |
| 27 | hereinafter referred to as "the theatre," located at 711 North |
| 28 | Franklin Street, Tampa. The council shall pay the applicable |
| 29 | license fee provided in section 565.02, Florida Statutes. The |
| 30 | license may be used for special events only. |
| 31 | Section 2. Alcoholic beverages may be sold by the licensee |
| 32 | for consumption within the theatre. The license issued pursuant |
| 33 | to this act shall not permit the sale of alcoholic beverages in |
| 34 | sealed containers for consumption outside the building. Nothing |
| 35 | in this act shall prevent a purchaser of such alcoholic |
| 36 | beverages from removing an opened, partially consumed container |
| 37 | of alcoholic beverages from the premises of the theatre. |
| 38 | Section 3. The council may transfer the license from time |
| 39 | to time to qualified applicants who are either authorized by or |
| 40 | under contract with the council to provide food services at the |
| 41 | theatre. Upon termination of a transferee's authorization or |
| 42 | contract, the license automatically reverts by operation of law |
| 43 | to the council. |
| 44 | Section 4. This act shall take effect upon becoming a law. |
