11  The Committee on Regulated Industries (Geller) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 2, lines 14-24, delete those lines
16  
17  and insert:  
18         Section 2.  Section 386.2045, Florida Statutes, is
19  amended to read:
20         386.2045  Enclosed indoor workplaces; specific
21  exceptions.--Notwithstanding s. 386.204, tobacco smoking may
22  be permitted in each of the following places:
23         (1)  PRIVATE RESIDENCE.--A private residence whenever
24  it is not being used commercially to provide child care, adult
25  care, or health care, or any combination thereof as defined in
26  s. 386.203(1).
27         (2)  RETAIL TOBACCO SHOP.--An enclosed indoor workplace
28  dedicated to or predominantly for the retail sale of tobacco,
29  tobacco products, and accessories for such products, as
30  defined in s. 386.203(8).
31         (3)  DESIGNATED SMOKING GUEST ROOM.--A designated

Florida Senate - 2005 COMMITTEE AMENDMENT Bill No. SB 1348 Barcode 805440 1 smoking guest room at a public lodging establishment as 2 defined in s. 386.203(4). 3 (4) STAND-ALONE BAR.--A business that meets the 4 definition of a stand-alone bar as defined in s. 386.203(11) 5 and that otherwise complies with all applicable provisions of 6 the Beverage Law and this part. 7 (5) SMOKING CESSATION PROGRAM, MEDICAL OR SCIENTIFIC 8 RESEARCH.--An enclosed indoor workplace, to the extent that 9 tobacco smoking is an integral part of a smoking cessation 10 program approved by the department, or medical or scientific 11 research conducted therein. Each room in which tobacco smoking 12 is permitted must comply with the signage requirements in s. 13 386.206. 14 (6) CUSTOMS SMOKING ROOM.--A customs smoking room in 15 an airport in-transit lounge under the authority and control 16 of the Bureau of Customs and Border Protection of the United 17 States Department of Homeland Security subject to the 18 restrictions contained in s. 386.205. 19 (7) EXPRESSIVE ACTIVITY.--Any enclosed indoor 20 workplace or public place to the extent that tobacco smoking 21 is done upon a stage and done by the performers during the 22 course of, and is a part of, the theatrical production. 23 and redesignate subsequent sections. 24 25 26 ================ T I T L E A M E N D M E N T =============== 27 And the title is amended as follows: 28 On page 1, line 14, before the semicolon 29 30 insert: 31 , creating a new exception 2 10:00 AM 04/04/05 s1348.ri31.002
