| 7 | F.S.; requiring a nurse registry to provide information |
| 8 | regarding additional visits by registered nurses and the |
| 9 | cost thereof; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Paragraph (c) of subsection (10) of section |
| 14 | 400.506, Florida Statutes, is amended to read: |
| 15 | 400.506 Licensure of nurse registries; requirements; |
| 16 | penalties.-- |
| 17 | (10) |
| 18 | (c) When a certified nursing assistant or home health aide |
| 19 | is referred to a patient's home by a nurse registry, the nurse |
| 20 | registry shall advise the patient, the patient's family, or a |
| 21 | person acting on behalf of the patient at the time of |
| 22 | contracting for services through the nurse registry of the |
| 23 | availability of registered nurses to visit the patient's home to |
| 24 | assess the patient's condition at an additional cost. A |
| 25 | registered nurse shall make monthly visits to the patient's home |
| 26 | to assess the patient's condition and quality of care being |
| 27 | provided by the certified nursing assistant or home health aide. |
| 28 | Any condition which in the professional judgment of the nurse |
| 29 | requires further medical attention shall be reported to the |
| 30 | attending physician and the nurse registry. The assessment shall |
| 31 | become a part of the patient's file with the nurse registry and |
| 32 | may be reviewed by the agency during their survey procedure. |
| 33 | Section 2. This act shall take effect July 1, 2005. |
