| 13 | abuse delivery component of this program without delay in |
| 14 | the expansion districts and furnish status reports to the |
| 15 | appropriate substantive committees of the Senate and the |
| 16 | House of Representatives by specified dates; requiring the |
| 17 | department to monitor and evaluate the expansion project; |
| 18 | providing an effective date. |

| 20 | Be It Enacted by the Legislature of the State of Florida: |
| 21 |
|
| 22 | Section 1. Subsection (8) of section 394.9082, Florida |
| 23 | Statutes, is amended to read: |
| 24 | 394.9082 Behavioral health service delivery strategies.-- |
| 25 | (8) EXPANSION IN DISTRICTS 2, 3, 4, AND 12, AND 13.--The |
| 26 | department shall work with the North East Florida Addictions |
| 27 | Network community agencies to establish a single managing entity |
| 28 | for districts 2, 3, 4, and 12, and 13 accountable for the |
| 29 | delivery of substance abuse services to child protective |
| 30 | services recipients in the five two districts. The purpose of |
| 31 | this strategy is to enhance the coordination of substance abuse |
| 32 | services with the North East Florida Addictions Network, |
| 33 | community-based care agencies, and the department. The |
| 34 | department shall work with affected stakeholders to develop and |
| 35 | implement a plan that allows the phase-in of services beginning |
| 36 | with the delivery of substance abuse services, with phase-in of |
| 37 | subsequent substance abuse services agreed upon by the North |
| 38 | East Florida Addictions Network the managing entity and |
| 39 | authorized by the department, providing the necessary technical |
| 40 | assistance to assure provider and district readiness for |
| 41 | implementation. When a single managing entity is established and |
| 42 | meets readiness requirements, The department may enter into a |
| 43 | noncompetitive contract with the North East Florida Addictions |
| 44 | Network entity. The department shall maintain detailed |
| 45 | information on the methodology used for selection and a |
| 46 | justification for the selection. Performance objectives shall be |
| 47 | developed which ensure that services that are delivered directly |
| 48 | affect and complement the child's permanency plan. During the |
| 49 | initial planning and implementation phase of this expansion |
| 50 | project, the requirements in subsections (6) and (7) are waived. |
| 51 | Considering the critical substance abuse problems experienced by |
| 52 | many families in the child protection system, the department |
| 53 | shall initiate the implementation of the substance abuse |
| 54 | delivery component of this program without delay and furnish |
| 55 | status reports to the appropriate substantive committees of the |
| 56 | Senate and the House of Representatives no later than February |
| 57 | 29, 2004, and February 28, 2005, and February 27, 2006. The |
| 58 | integration of all services agreed upon by the North East |
| 59 | Florida Addictions Network managing entity and authorized by the |
| 60 | department must be completed within 2 years after initiation of |
| 61 | the expansion project initiation. Ongoing monitoring and |
| 62 | evaluation of this strategy shall be conducted in accordance |
| 63 | with subsection (9). |
| 64 | Section 2. This act shall take effect July 1, 2005. |
