| 5 | Section 5. Notwithstanding section 287.057(14)(a), Florida |
| 6 | Statutes, the Department of Children and Family Services may |
| 7 | enter into agreements, not to exceed 23 years, with a private |
| 8 | contractor to finance, design, and construct a secure facility, |
| 9 | as described in section 394.917, Florida Statutes, of at least |
| 10 | 600 beds and to operate all aspects of daily operations within |
| 11 | the secure facility. The contractor may sponsor the issuance of |
| 12 | tax-exempt certificates of participation or other securities to |
| 13 | finance the project, and the state may enter into a lease- |
| 14 | purchase agreement for the secure facility. The department shall |
| 15 | begin the implementation of this privatization initiative by |
| 16 | July 1, 2005. This section is repealed July 1, 2006. |
