| 6 | Safety Belt Law." |
| 7 | Section 8. Subsection (8) of section 316.614, Florida |
| 8 | Statutes, is amended to read: |
| 9 | 316.614 Safety belt usage.-- |
| 10 | (8) Any person who violates the provisions of this section |
| 11 | commits a nonmoving violation, punishable as provided in chapter |
| 12 | 318. By January 1, 2006, each law enforcement agency in this |
| 13 | state shall adopt departmental policy to prohibit the practice |
| 14 | of racial profiling. When a law enforcement officer issues a |
| 15 | citation for a violation of this section, the law enforcement |
| 16 | officer must record the race and ethnicity of the violator. All |
| 17 | law enforcement agencies must maintain such information and |
| 18 | forward the information to the department in a form and manner |
| 19 | determined by the department. The department shall collect this |
| 20 | information by jurisdiction and annually report the data to the |
| 21 | Governor, the President of the Senate, and the Speaker of the |
| 22 | House of Representatives. The report must show separate |
| 23 | statewide totals for the state's county sheriffs and municipal |
| 24 | law enforcement agencies, state law enforcement agencies, and |
| 25 | state university law enforcement agencies. However, except for |
| 26 | violations of s. 316.613, enforcement of this section by state |
| 27 | or local law enforcement agencies must be accomplished only as a |
| 28 | secondary action when a driver of a motor vehicle has been |
| 29 | detained for a suspected violation of another section of this |
| 30 | chapter, chapter 320, or chapter 322. |
