  1                      A bill to be entitled

  2         An act relating to child support; amending s.

  3         409.2558, F.S.; requiring the Department of

  4         Revenue, prior to determining a collection or

  5         refund to be undistributable to make reasonable

  6         efforts to locate persons to whom collections

  7         or refunds are owed, including disclosure on

  8         the Internet of information with appropriate

  9         safeguards to protect the privacy of the

10         persons named in the database; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Paragraph (a) of subsection (2) of section

16  409.2558, Florida Statutes, is amended to read:

17         409.2558  Support distribution and disbursement.--

18         (2)  UNDISTRIBUTABLE COLLECTIONS.--

19         (a)  The department shall establish by rule the method

20  for determining a collection or refund to a noncustodial

21  parent to be undistributable to the final intended recipient.

22  Before determining a collection or refund to be

23  undistributable, the department shall make reasonable efforts

24  to locate persons to whom collections or refunds are owed so

25  that payment can be made. Location efforts may include

26  disclosure through a searchable database of the names of

27  obligees, obligors, and depository account numbers on the

28  Internet in compliance with the requirements of s.

29  119.01(2)(a).

30         Section 2.  This act shall take effect July 1, 2005.
