| 7 | Section 15. Department of Transportation study of |
| 8 | transportation facilities providing access to pari-mutuel |
| 9 | facilities and Indian reservations; report and recommendations |
| 10 | authorized.-- |
| 11 | (1) The Department of Transportation is directed to |
| 12 | conduct a study of the impacts that slot machine gaming at pari- |
| 13 | mutuel facilities and on Indian reservation lands is having on |
| 14 | public roads and other transportation facilities, regarding |
| 15 | traffic congestion and other mobility issues, facility |
| 16 | maintenance and repair costs, emergency evacuation readiness, |
| 17 | and costs of potential future widening or other improvements, |
| 18 | and of other impacts on the motoring, nongaming public. |
| 19 | (2) The study shall include, but is not limited to, the |
| 20 | following information: |
| 21 | (a) A listing, description, and functional classification |
| 22 | of the access roads to and from pari-mutuel facilities and |
| 23 | Indian reservations that conduct slot machine gaming in the |
| 24 | state. |
| 25 | (b) An identification of the access roads identified under |
| 26 | paragraph (a) that are either scheduled for improvements within |
| 27 | the Department of Transportation's 5-year work program or are |
| 28 | listed on the 20-year, long-range transportation plan of the |
| 29 | department or a metropolitan planning organization. |
| 30 | (c) The most recent traffic counts on the access roads and |
| 31 | projected future usage, as well as any projections of impacts on |
| 32 | secondary, feeder, or connector roads, interstate highway exit |
| 33 | and entrance ramps, or other area transportation facilities. |
| 34 | (d) The safety and maintenance ratings of each access road |
| 35 | and a detailed review of impacts on local and state emergency |
| 36 | management agencies to provide emergency or evacuation services. |
| 37 | (e) The estimated infrastructure costs to maintain, |
| 38 | improve, or widen these access roads based on future projected |
| 39 | needs. |
| 40 | (f) The feasibility of implementing tolls on these access |
| 41 | roads or, if already tolled, raising the toll to offset and |
| 42 | mitigate the impacts of traffic generated by pari-mutuel |
| 43 | facility and Indian reservation slot machine gaming activities |
| 44 | on nontribal communities in the state and to finance projected |
| 45 | future improvements to the access roads. |
| 46 | (3) The department shall present its findings and |
| 47 | recommendations in a report to be submitted to the Governor, the |
| 48 | President of the Senate, and the Speaker of the House of |
| 49 | Representatives by January 15, 2006. The report may include any |
| 50 | department recommendations for proposed legislation. |
