1	A bill to be entitled
2	An act relating to a review under the Open Government
3	Sunset Review Act; amending s. 311.13, F.S., which
4	provides a public records exemption for seaport security
5	plans of a seaport authority created by act of the
6	Legislature or of a seaport department of a county or
7	municipality that operates an international seaport;
8	removing the October 2, 2005, repeal thereof scheduled
9	under the Open Government Sunset Review Act; making
10	editorial changes; providing an effective date.

12	Be It Enacted by the Legislature of the State of Florida:
13
14	Section 1.  Section 311.13, Florida Statutes, is amended to
15	read:
16	311.13  Certain information exempt from
17	disclosure.--Seaport security plans of a seaport authority
18	created by act of the Legislature or of a seaport department of
19	a county or municipality that operates an international seaport
20	are exempt from provisions of s. 119.07(1) and s. 24(a), Art. I
21	of the State Constitution. In addition, photographs, maps,
22	blueprints, drawings, and similar materials that depict critical
23	seaport operating facilities are exempt from the provisions of
24	s. 119.07(1) and s. 24(a), Art. I of the State Constitution, to
25	the extent that a seaport authority created by act of the
26	Legislature or a seaport department of a county or municipality
27	that operates a seaport reasonably determines that such items
28	contain information that is not generally known and that could
29	jeopardize the security of the seaport; however, information
30	relating to real estate leases, layout plans, blueprints, or
31	information relevant thereto, is not to be included in this
32	exemption. The exemptions in this section are applicable only to
33	records held by a seaport authority created by act of the
34	Legislature or to records of a county or municipal seaport
35	department that operates a seaport. The exemptions contained in
36	this section are subject to the Open Government Sunset Review
37	Act of 1995, in accordance with s. 119.15, and this section
38	shall stand repealed on October 2, 2005, unless reviewed and
39	saved from repeal through reenactment by the Legislature.
40	Section 2.  This act shall take effect October 1, 2005.
