14 Lines 338 through 378, delete those lines

16 and insert:
17 Section 14. Subsection (16) of section 570.07, Florida
18 Statutes, is amended to read:
19 570.07 Department of Agriculture and Consumer
20 Services; functions, powers, and duties.--The department shall
21 have and exercise the following functions, powers, and duties:
22 (16) To enforce the state laws and rules relating to:
23 (a) Fruit and vegetable inspection and grading;
24 (b) Pesticide spray, residue inspection, and removal;
25 (c) Registration, labeling, inspection, and analysis
26 of commercial stock feeds and commercial fertilizers;
27 (d) Classification, inspection, and sale of poultry
28 and eggs;
29 (e) Registration, inspection, and analysis of
30 gasolines and oils;
31 (f) Registration, labeling, inspection, and analysis

1 of pesticides;
2 (g) Registration, labeling, inspection, germination
3 testing, and sale of seeds, both common and certified;
4 (h) Weights, measures, and standards;
5 (i) Foods, as set forth in the Florida Food Safety
6 Act;
7 (j) Inspection and certification of honey;
8 (k) Sale of liquid fuels;
9 (l) Licensing of dealers in agricultural products;
10 (m) Administration and enforcement of all regulatory
11 legislation applying to milk and milk products, ice cream, and
12 frozen desserts;
13 (n) Recordation and inspection of marks and brands of
14 livestock; and
15 (o) All other regulatory laws relating to agriculture.

17 In order to ensure uniform health and safety standards, the
18 adoption of standards and fines in the subject areas of
19 paragraphs (a)-(n) is expressly preempted to the state and the
20 Department of Agriculture and Consumer Services. Any local
21 government enforcing the subject areas of paragraphs (a)-(n)
22 must use the standards and fines set forth in the pertinent
23 statutes or any rules adopted by the department pursuant to
24 those statutes.
