| 5 | Section 7. Paragraph (d) of subsection (1) of section |
| 6 | 409.9081, Florida Statutes, is amended to read: |
| 7 | 409.9081 Copayments.-- |
| 8 | (1) The agency shall require, subject to federal |
| 9 | regulations and limitations, each Medicaid recipient to pay at |
| 10 | the time of service a nominal copayment for the following |
| 11 | Medicaid services: |
| 12 | (d) Prescription drugs: a copayment of $1 for each |
| 13 | prescription of a brand-name drug. Providers, after providing |
| 14 | advance notice and reasonable opportunity for payment, may elect |
| 15 | not to serve recipients with a history of bad debt, which may |
| 16 | include nonpayment of copayments coinsurance equal to 2.5 |
| 17 | percent of the Medicaid cost of the prescription drug at the |
| 18 | time of purchase. The maximum coinsurance shall be $7.50 per |
| 19 | prescription drug purchased. |
