| 5 | Section 2. Section 810.14, Florida Statutes, is amended to |
| 6 | read: |
| 7 | 810.14 Voyeurism prohibited; penalties.-- |
| 8 | (1) A person commits the offense of voyeurism when he or |
| 9 | she, with lewd, lascivious, or indecent intent, secretly |
| 10 | observes, photographs, films, videotapes, or records another |
| 11 | person when the such other person is located in a dwelling, |
| 12 | structure, or conveyance and such location provides a reasonable |
| 13 | expectation of privacy. |
| 14 | (2) A person who violates this section commits a |
| 15 | misdemeanor of the first degree for the first violation, |
| 16 | punishable as provided in s. 775.082 or s. 775.083. |
| 17 | (3) A person who violates this section and who has been |
| 18 | previously convicted or adjudicated delinquent two or more times |
| 19 | of any violation of this section commits a felony of the third |
| 20 | degree, punishable as provided in s. 775.082, s. 775.083, or s. |
| 21 | 775.084. |
| 22 | (4) For purposes of this section, a person has been |
| 23 | previously convicted or adjudicated delinquent of a violation of |
| 24 | this section if the violation resulted in a conviction sentenced |
| 25 | separately, or an adjudication of delinquency entered |
| 26 | separately, prior to the current offense. |

| 40 | 810.14, F.S.; revising the elements of the offense of |
| 41 | voyeurism in order to eliminate acts of photographing, |
| 42 | filming, videotaping, or recording, which are made a crime |
| 43 | under the offense of video voyeurism; providing that a |
| 44 | person commits the offense of voyeurism when he or she |
| 45 | secretly observes another person while the other person is |
| 46 | in a location that provides a reasonable expectation of |
| 47 | privacy; amending s. 812.014, F.S.; providing enhanced |
| 48 | penalties for the theft of certain property stolen during |
| 49 | a state of emergency; directing that a felony theft |
| 50 | committed during a state of emergency be reclassified one |
| 51 | level above the current ranking of the offense committed; |
| 52 | providing an effective date. |
