  3         s. 468.707, F.S.; revising the requirements for
  4         licensure as an athletic trainer; amending s.
  5         468.711, F.S.; revising the criteria for
  6         continuing education in athletic training;
  7         amending s. 468.717, F.S.; providing that a
  8         person who practices athletic training without
  9         holding an active license commits a
10         first-degree misdemeanor regardless of whether
11         the person receives compensation; amending s.
12         468.723, F.S.; providing that a person employed
13         as an apprentice trainer or athletic trainer is
14         not exempt from part XIII of ch. 468, F.S.;
15         amending s. 1012.46, F.S.; deleting the
16         classification of first responder in a school
17         district's athletic injuries prevention and
18         treatment program; requiring that an athletic
19         trainer employed by a school district be
20         licensed as an athletic trainer; deleting a
21         requirement that such person possess certain
22         certification as an educator; providing an
23         effective date.

25  Be It Enacted by the Legislature of the State of Florida:
26  
27         Section 1.  Subsection (1) of section 468.707, Florida
28  Statutes, is amended to read:
29         468.707  Licensure by examination; requirements.--

 1         (1)  Any person desiring to be licensed as an athletic
 2  trainer shall apply to the department on a form approved by
 3  the department.
 4         (a)  The department shall license each applicant who:
 5         (a)1.  Has completed the application form and remitted
 6  the required fees.
 7         (b)2.  Is at least 21 years of age.
 8         (c)3.  Has obtained a baccalaureate degree from a
 9  college or university accredited by an accrediting agency
10  recognized and approved by the United States Department of
11  Education or the Commission on Recognition of Postsecondary
12  Accreditation, or approved by the board.
13         (d)4.  Has completed an approved athletic training
14  curriculum coursework from a college or university accredited
15  by an accrediting agency recognized and approved by the United
16  States Department of Education or the Commission on
17  Recognition of Postsecondary Accreditation, or approved by the
18  board, in each of the following areas, as provided by rule:
19  health, human anatomy, kinesiology/biomechanics, human
20  physiology, physiology of exercise, basic athletic training,
21  and advanced athletic training.
22         (e)5.  Has current certification in standard first aid
23  and cardiovascular pulmonary resuscitation from the American
24  Red Cross or an equivalent certification as determined by the
25  board.
26         6.  Has, within 2 of the preceding 5 years, attained a
27  minimum of 800 hours of athletic training experience under the
28  direct supervision of a licensed athletic trainer or an
29  athletic trainer certified by the National Athletic Trainers'
30  Association or a comparable national athletic standards
31  organization.

 1         (f)7.  Has passed an examination administered or
 2  approved by the board.
 3         (b)  The department shall also license each applicant
 4  who:
 5         1.  Has completed the application form and remitted the
 6  required fees no later than October 1, 1996.
 7         2.  Is at least 21 years of age.
 8         3.  Has current certification in standard first aid and
 9  cardiovascular pulmonary resuscitation from the American Red
10  Cross or an equivalent certification as determined by the
11  board.
12         4.a.  Has practiced athletic training for at least 3 of
13  the 5 years preceding application; or
14         b.  Is currently certified by the National Athletic
15  Trainers' Association or a comparable national athletic
16  standards organization.
17         Section 2.  Section 468.711, Florida Statutes, is
18  amended to read:
19         468.711  Renewal of license; continuing education.--
20         (1)  The department shall renew a license upon receipt
21  of the renewal application and fee, provided the applicant is
22  in compliance with the provisions of this part, chapter 456,
23  and rules promulgated pursuant thereto.
24         (2)  The board may, by rule, prescribe continuing
25  education requirements, not to exceed 24 hours biennially.
26  The criteria for continuing education shall be approved by the
27  board and shall include a current certificate in include 4
28  hours in standard first aid and cardiovascular pulmonary
29  resuscitation from the American Red Cross or equivalent
30  training as determined by the board.

 1         (3)  Pursuant to the requirements of s. 456.034, each
 2  licensee shall complete a continuing education course on human
 3  immunodeficiency virus and acquired immune deficiency syndrome
 4  as part of biennial relicensure.
 5         Section 3.  Subsection (1) of section 468.717, Florida
 6  Statutes, is amended to read:
 7         468.717  Violations and penalties.--Each of the
 8  following acts constitutes a misdemeanor of the first degree,
 9  punishable as provided in s. 775.082 or s. 775.083:
10         (1)  Practicing athletic training for compensation
11  without holding an active license under this part.
12         Section 4.  Section 468.723, Florida Statutes, is
13  amended to read:
14         468.723  Exemptions.--Nothing in This part does not
15  prevent or restrict shall be construed as preventing or
16  restricting:
17         (1)  The professional practice of a licensee of the
18  department who is acting within the scope of such practice.
19         (2)  An athletic training A student athletic trainer
20  acting under the direct supervision of a licensed athletic
21  trainer.
22         (3)  A person employed as a teacher apprentice trainer
23  I, a teacher apprentice trainer II, or a teacher athletic
24  trainer under s. 1012.46.
25         (3)(4)  A person from administering standard first aid
26  treatment to an athlete.
27         (4)(5)  A person licensed under chapter 548, provided
28  such person is acting within the scope of such license.
29         (5)(6)  A person providing personal training
30  instruction for exercise, aerobics, or weightlifting, if the
31  person does not represent himself or herself as able to

 1  provide "athletic trainer" services and if any recognition or
 2  treatment of injuries is limited to the provision of first
 3  aid.
 4         Section 5.  Section 1012.46, Florida Statutes, is
 5  amended to read:
 6         1012.46  Athletic trainers.--
 7         (1)  School districts may establish and implement an
 8  athletic injuries prevention and treatment program. Central to
 9  this program should be the employment and availability of
10  persons trained in the prevention and treatment of physical
11  injuries that which may occur during athletic activities. The
12  program should reflect opportunities for progressive
13  advancement and compensation in employment as provided in
14  subsection (2) and meet certain other minimum standards
15  developed by the Department of Education. The goal of the
16  Legislature is to have school districts employ and have
17  available a full-time teacher athletic trainer in each high
18  school in the state.
19         (2)  To the extent practicable, a school district
20  program should include the following employment classification
21  and advancement scheme:
22         (a)  First responder.--To qualify as a first responder,
23  a person must possess a professional, temporary, part-time,
24  adjunct, or substitute certificate pursuant to s. 1012.56, be
25  certified in cardiopulmonary resuscitation, first aid, and
26  have 15 semester hours in courses such as care and prevention
27  of athletic injuries, anatomy, physiology, nutrition,
28  counseling, and other similar courses approved by the
29  Commissioner of Education. This person may only administer
30  first aid and similar care.

 1         (2)(b)  Teacher athletic trainer.--To qualify as an a
 2  teacher athletic trainer, a person must be licensed as
 3  required by part XIII of chapter 468 and may possess a
 4  professional, temporary, part-time, adjunct, or substitute
 5  certificate pursuant to s. 1012.35, s. 1012.56, or s. 1012.57,
 6  and be licensed as required by part XIII of chapter 468.
 7         Section 6.  This act shall take effect upon becoming a
 8  law.
