| 2 | An act relating to law enforcement, correctional, and  |

| 4 | F.S.; providing for a payout of a limited amount of  | 
| 5 | accumulated annual leave in certain circumstances;  | 
| 6 | providing an effective date. |

| 8 | Be It Enacted by the Legislature of the State of Florida: | 
| 9 | 
  | 
| 10 |      Section 1.  Subsection (8) is added to section 110.219,  | 
| 11 | Florida Statutes, to read: | 
| 12 |      110.219  Attendance and leave; general policies.-- | 
| 13 |      (8)  Notwithstanding subsection (7) and s. 110.2037, each  | 
| 14 | December a law enforcement officer, correctional officer, or  | 
| 15 | correctional probation officer with at least 20 years of full- | 
| 16 | time service with the state shall be entitled to a payout of up  | 
| 17 | to 48 hours of annual leave subject to the following conditions: | 
| 18 |      (a)  The employee must have an annual leave balance of no  | 
| 19 | less than 240 hours after the payout in order to qualify for  | 
| 20 | this benefit. | 
| 21 |      (b)  The payout must be deposited in a tax-sheltered plan  | 
| 22 | under s. 401(a) of the Internal Revenue Code, as provided for in  | 
| 23 | s. 110.2037. |

| 25 | This payout shall be in addition to any payout provided for in  | 
| 26 | subsection (7). | 
| 27 |      Section 2.  This act shall take effect July 1, 2005. |
