| 6 | An act relating to law enforcement, correctional, and |
| 7 | correctional probation officers; amending s. 110.219, |
| 8 | F.S.; authorizing and providing conditions for a payout of |
| 9 | a limited amount of accumulated annual leave each year; |
| 10 | providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Subsection (7) of section 110.219, Florida |
| 15 | Statutes, is amended and subsection (8) is added to said section |
| 16 | to read: |
| 17 | 110.219 Attendance and leave; general policies.-- |
| 18 | (7) Each December, a permanent career service employee |
| 19 | shall be entitled, subject to available funds, to a payout of up |
| 20 | to 24 hours of unused annual leave as follows: |
| 21 | (a) A permanent career service employee must have an |
| 22 | annual leave balance of no less than 24 hours, after the payout, |
| 23 | in order to qualify for this benefit. |
| 24 | (b) No permanent career service employee shall receive a |
| 25 | payout of greater than 240 hours over the course of the |
| 26 | employee's career with the state, including any leave received |
| 27 | at the time of separation, except that the payout provided by |
| 28 | subsection (8) shall not count toward this limit. |
| 29 | (8) Notwithstanding the eligibility requirements of s. |
| 30 | 110.2037, each December, a law enforcement officer, correctional |
| 31 | officer, or correctional probation officer with at least 20 |
| 32 | years of full-time service with the state shall be entitled to a |
| 33 | payout of up to 48 hours of unused annual leave subject to the |
| 34 | following conditions: |
| 35 | (a) The employee must have an annual leave balance of no |
| 36 | less than 240 hours after the payout in order to qualify for |
| 37 | this benefit. |
| 38 | (b) The payout must be deposited in a tax-sheltered plan |
| 39 | under s. 401(a) of the Internal Revenue Code, as provided for in |
| 40 | s. 110.2037. |

| 42 | This payout shall be in addition to any payout provided for in |
| 43 | subsection (7). |
| 44 | Section 2. This act shall take effect July 1, 2005. |
