11 The Committee on Education (Lynn) recommended the following
12 amendment:

15 Delete everything after the enacting clause

17 and insert:
18 Section 1. Section 125.5805, Florida Statutes, is
19 created to read:
20 125.5805 For-hire bus drivers; transport of school
21 students; required local ordinances; minimum requirements;
22 reimbursement of costs; exclusion.--
23 (1) No later than January 1, 2006, all counties must
24 adopt an ordinance that requires every driver of a motor
25 vehicle that is regularly used for the transportation of
26 students to or from school, or to or from school activities,
27 who receives compensation for such services to register with
28 the county.
29 (2) The ordinance shall require, at a minimum, that
30 each driver provide documentation that the driver:
31 (a) Has met level 2 background screening standards set

1 forth in chapter 435; and
2 (b) Holds a valid commercial driver's license with a
3 passenger endorsement.
4 (3) Each driver shall reimburse the county for any
5 costs of background screening or for any other expenses
6 related to administration of the ordinance.
7 (4) The provisions of this section do not apply to
8 drivers employed by a public school or private school who meet
9 the requirements of s. 1012.45 or s. 1002.42.
10 Section 2. This act shall take effect July 1, 2005.

19 An act relating to for-hire bus drivers;
20 creating s. 125.5805, F.S.; requiring counties
21 to adopt ordinances relating to registration of
22 drivers who transport school students for hire;
23 providing specified qualifications, including
24 background screening and commercial driver
25 licensure; providing for applicability;
26 providing an effective date.
