| 10 | and reinstatement of voided licenses, including fees, |
| 11 | continuing education, and eligibility; excluding public |
| 12 | accountants from application of provisions relating to |
| 13 | delinquent status and reinstatement of void licenses; |
| 14 | providing an effective date. |

| 16 | Be It Enacted by the Legislature of the State of Florida: |
| 17 |
|
| 18 | Section 1. Subsection (6) of section 455.271, Florida |
| 19 | Statutes, is amended to read: |
| 20 | 455.271 Inactive and delinquent status.-- |
| 21 | (6)(a) A delinquent status licensee must affirmatively |
| 22 | apply with a complete application, as defined by rule of the |
| 23 | board, or the department if when there is no board, for active |
| 24 | or inactive status during the licensure cycle in which a |
| 25 | licensee becomes delinquent. Failure by a delinquent status |
| 26 | licensee to become active or inactive before the expiration of |
| 27 | the current licensure cycle shall render the license void null |
| 28 | without any further action by the board or the department. Any |
| 29 | subsequent licensure shall be as a result of applying for and |
| 30 | meeting all requirements imposed on an applicant for new |
| 31 | licensure. |
| 32 | (b) Notwithstanding the provisions of the professional |
| 33 | practice acts administered by the department, the board, or the |
| 34 | department if there is no board, may, at its discretion, |
| 35 | reinstate the license of an individual whose license has become |
| 36 | void if the board or department, as applicable, determine that |
| 37 | the individual has made a good-faith effort to comply with this |
| 38 | section but has failed to comply because of illness or unusual |
| 39 | hardship. The individual must apply to the board, or the |
| 40 | department if there is no board, for reinstatement in a manner |
| 41 | prescribed by rules of the board or the department, as |
| 42 | applicable, and shall pay an applicable fee in an amount |
| 43 | determined by rule. The board, or the department if there is no |
| 44 | board, shall require that such individual meet all continuing |
| 45 | education requirements prescribed by law, pay appropriate |
| 46 | licensing fees, and otherwise be eligible for renewal of |
| 47 | licensure under this chapter. This subsection does not apply to |
| 48 | individuals licensed under chapter 473. |
| 49 | Section 2. This act shall take effect July 1, 2005. |
