| 6 | Section 3. Section 828.32, Florida Statutes, is created to |
| 7 | read: |
| 8 | 828.32 Animal health care services.--This chapter does not |
| 9 | apply to any person, or the person's regular employee, who tends |
| 10 | to her or his own animals, including, but not limited to, |
| 11 | castration, spaying, and dehorning of herd animals, unless title |
| 12 | has been transferred or employment provided for the purpose of |
| 13 | circumventing this chapter. This exemption extends to an |
| 14 | independent contractor under the supervision of the animal's |
| 15 | owner if such person does not diagnose, claim to cure, or commit |
| 16 | animal abuse. For the owner, employee, or independent |
| 17 | contractor, this exemption extends to any person who is trained, |
| 18 | educated, or experienced in castration, spaying, and dehorning |
| 19 | of herd animals; acupressure; aromatherapy; animal |
| 20 | communication; hoof care; flower-essence therapy; hands-on |
| 21 | healing; homeopathy; light therapy; magnet therapy; manual |
| 22 | floating of equine teeth; or nutritional counseling if such |
| 23 | services for the animal are under the supervision of the |
| 24 | animal's owner. This exemption does not apply to out-of-state |
| 25 | veterinarians practicing temporarily in the state. However, only |
| 26 | a veterinarian may immunize or treat an animal for diseases that |
| 27 | are communicable to humans and are of public health |
| 28 | significance. |
