2An act relating to emergency medical services; amending s.
3401.107, F.S.; defining the term "youth athletic
4organization"; amending s. 401.111, F.S.; providing for
5grants to local agencies, emergency medical services
6organizations, and youth athletic organizations for the
7procurement of automated external defibrillators; amending
8s. 401.113, F.S.; providing for disbursement of funds from
9the Emergency Medical Services Trust Fund; providing an
10effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Subsection (6) is added to section 401.107,
15Florida Statutes, to read:
16     401.107  Definitions.--As used in this part, the term:
17     (6)  "Youth athletic organization" means a private
18not-for-profit organization that promotes and provides organized
19athletic activities to youth.
20     Section 2.  Section 401.111, Florida Statutes, is amended
21to read:
22     401.111  Emergency medical services grant program;
23authority.--The department is hereby authorized to make grants
24to local agencies, and emergency medical services organizations,
25and youth athletic organizations for the procurement of
26automated external defibrillators in accordance with any
27agreement entered into pursuant to this part. These grants shall
28be designed to assist local said agencies, emergency medical
29services organizations, and youth athletic and organizations in
30providing emergency medical services, including emergency
31medical dispatch, through the use of automated external
32defibrillators. The cost of administering this program shall be
33paid by the department from funds appropriated to it.
34     Section 3.  Paragraphs (a) and (b) of subsection (2) of
35section 401.113, Florida Statutes, are amended to read:
36     401.113  Department; powers and duties.--
37     (2)  The department shall annually dispense funds contained
38in the Emergency Medical Services Trust Fund as follows:
39     (a)  Forty-five percent of such moneys must be divided
40among the counties according to the proportion of the combined
41amount deposited in the trust fund from the county. These funds
42may not be used to match grant funds as identified in paragraph
43(b). An individual board of county commissioners may distribute
44these funds as it deems appropriate to emergency medical service
45organizations and youth athletic organizations within the
46county, as provided in this part it deems appropriate.
47     (b)  Forty percent of such moneys must be used by the
48department for making matching grants to local agencies,
49municipalities, and emergency medical services organizations,
50and youth athletic organizations for the purpose of conducting
51research, increasing existing levels of emergency medical
52services, evaluation, community education, injury-prevention
53programs, and training in cardiopulmonary resuscitation and
54other lifesaving and first aid techniques.
55     1.  At least 90 percent of these moneys must be made
56available on a cash matching basis. A grant made under this
57subparagraph must be contingent upon the recipient providing a
58cash sum equal to 25 percent of the total department-approved
59grant amount.
60     2.  No more than 10 percent of these moneys must be made
61available to rural emergency medical services, and
62notwithstanding the restrictions specified in subsection (1),
63these moneys may be used for improvement, expansion, or
64continuation of services provided. A grant made under this
65subparagraph must be contingent upon the recipient providing a
66cash sum equal to no more than 10 percent of the total
67department-approved grant amount.

69The department shall develop procedures and standards for grant
70disbursement under this paragraph based on the need for
71emergency medical services, the requirements of the population
72to be served, and the objectives of the state emergency medical
73services plan.
74     Section 4.  This act shall take effect July 1, 2005.
