| 6 | An act relating to lewdness; amending s. 796.07, F.S.; |
| 7 | redefining the term "lewdness" for purposes of provisions |
| 8 | prohibiting and providing penalties for prostitution, |
| 9 | lewdness, or assignation; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. Paragraph (b) of subsection (1) of section |
| 14 | 796.07, Florida Statutes, is amended to read: |
| 15 | 796.07 Prohibiting prostitution, etc.; evidence; |
| 16 | penalties; definitions.-- |
| 17 | (1) As used in this section: |
| 18 | (b) "Lewdness" means any indecent or obscene act that may |
| 19 | cause substantial offense to one or more persons viewing it or |
| 20 | may otherwise substantially intrude upon the rights of others. A |
| 21 | lewd act may be offensive to, or may intrude upon the rights of, |
| 22 | a person who is a law enforcement officer. Lewdness is to be |
| 23 | determined based on what a reasonable member of the public might |
| 24 | find substantially offensive. |
| 25 | Section 2. This act shall take effect July 1, 2005. |
