8adopt and implement an indoor environmental quality policy
9which provides for periodic surveys; providing that the
10policy may include certain requirements; providing for
11indemnification under certain circumstances; requiring
12notice of indoor environmental quality training
13completion; requiring the State Board of Education to
14adopt rules; providing an effective date.

16Be It Enacted by the Legislature of the State of Florida:
17
18     Section 1.  Section 1013.381, Florida Statutes, is created
19to read:
20     1013.381  Indoor environmental quality.--
21     (1)  Each district school board shall adopt and implement
22an indoor environmental quality policy which shall provide
23procedures for periodic surveys of indoor environmental quality
24issues. The policy may:
25     (a)  Be developed and implemented in accordance with the
26United States Environmental Protection Agency's Indoor Air
27Quality Tools for Schools Program through which training and
28materials shall be provided by the United States Environmental
29Protection Agency at no cost to a school or school district.
30     (b)  Require that the school district provide, monitor, and
31maintain indoor environmental condition performance in
32accordance with American Society of Heating, Refrigerating and
33Air-Conditioning Engineers (ASHRAE) Standard 62.
34     (c)  Require that educational facilities be certified every
352 years by a professional engineer as meeting ASHRAE Standard
3662. Upon certification, the school district shall be indemnified
37for the life of the certificate from liability related to indoor
38environmental quality. A school district shall provide a copy of
39the engineer's certification to the Commissioner of Education.
40     (2)  Each school participating in the Indoor Air Quality
41Tools for Schools Program training must display its certificate
42of completion in a conspicuous manner.
43     (3)  The State Board of Education shall adopt rules to
44implement the provisions of this section.
45     Section 2.  This act shall take effect July 1, 2005.
