11  The Committee on Health Care (Rich) recommended the following
12  amendment:

14         Senate Amendment (with title amendment) 
15         On page 2, between lines 23 and 24,
16  
17  insert:  
18         (3)  Any person who intentionally or willfully:
19         (a)  Tampers with or otherwise renders an automated
20  external defibrillator inoperative, except during such time as
21  the automated external defibrillator is being serviced,
22  tested, repaired, or recharged, or except pursuant to court
23  order; or
24         (b)  Obliterates the serial number on an automated
25  external defibrillator for purposes of falsifying service
26  records,
27  
28  Commits a misdemeanor of the first degree, punishable as
29  provided in s. 775.082 or s. 775.083.
30         (4)  A local ordinance may require a person to obtain a
31  license, permit, or inspection certificate regarding automated

The ordinance may 3 provide that it is an infraction or a criminal offense for any 4 person to intentionally or willfully: 5 (a) Fail to properly service, recharge, repair, test, 6 or inspect an automated external defibrillator; 7 (b) Use the license, permit, or inspection certificate 8 of another person to service, recharge, repair, test, or 9 inspect an automated external defibrillator; 10 (c) Hold a permit or inspection certificate and allow 11 another person to use that permit or inspection certificate 12 number to service, recharge, repair, test, or inspect an 13 automated external defibrillator; or 14 (d) Use or permit the use of any license, permit, or 15 inspection certificate by any individual or organization other 16 than the one to whom the license, permit, or inspection 17 certificate is issued to service, recharge, repair, test, or 18 inspect an automated external defibrillator. 19 20 21 ================ T I T L E A M E N D M E N T =============== 22 And the title is amended as follows: 23 On page 1, line 8, after the semicolon, 24 25 insert: 26 providing that it is a first-degree misdemeanor 27 for a person to commit certain acts involving 28 the misuse of an automated external 29 defibrillator; authorizing a local government 30 to adopt an ordinance to license, permit, or 31 inspect automated external defibrillators; 2 2:10 PM 04/15/05 s0048.he34.01a
