| 6 | An act relating to the exercise of eminent domain by |
| 7 | municipalities; providing legislative intent; authorizing |
| 8 | certain municipalities to exercise the power of eminent |
| 9 | domain for public school purposes; providing for future |
| 10 | expiration; providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. The Legislature recognizes that certain |
| 15 | counties that have large student populations may have |
| 16 | difficulties in obtaining suitable land for the establishment of |
| 17 | public schools to serve those student populations. The intent of |
| 18 | the Legislature is to authorize municipalities within these |
| 19 | counties to exercise the power of eminent domain to aid those |
| 20 | counties' school districts in obtaining suitable land to meet |
| 21 | the needs of the districts' student population. |
| 22 | Section 2. A municipality located within a county that has |
| 23 | a public school student population in grades K-12 of 350,000 or |
| 24 | more before December 31, 2006, may exercise the power of eminent |
| 25 | domain for the purpose of obtaining lands to be conveyed by the |
| 26 | municipality to the school board of the school district within |
| 27 | which the municipality is located if the school board of that |
| 28 | county requests in writing that the municipality obtain such |
| 29 | land for conveyance to the school board and promises to use the |
| 30 | land to establish a public school thereon. Fulfilling the |
| 31 | purpose of this section is recognized as constituting a valid |
| 32 | municipal public purpose. This section expires January 1, 2007. |
| 33 | Such expiration does not affect an action in eminent domain |
| 34 | which was filed before January 1, 2007. |
| 35 | Section 3. This act shall take effect upon becoming a law. |
