| 35 | (2) Each year prior to establishing new managed care |
| 36 | rates, the agency shall review all prior year adjustments for |
| 37 | changes in trend, and shall reduce or eliminate those |
| 38 | adjustments which are not reasonable and which reflect policies |
| 39 | or programs which are not in effect. In addition, the agency |
| 40 | shall apply only those policy reductions applicable to the |
| 41 | fiscal year for which the rates are being set, which can be |
| 42 | accurately estimated and verified by an independent actuary, and |
| 43 | which have been implemented prior to or will be implemented |
| 44 | during the fiscal year. The agency shall pay rates at per- |
| 45 | member, per-month averages that equal, but do not exceed, the |
| 46 | amounts allowed for in the General Appropriations Act applicable |
| 47 | to the fiscal year for which the rates will be in effect; |
| 48 | however, in no event shall the agency pay rates that exceed on |
| 49 | an average statewide basis 92 percent of the Medicaid fee-for- |
| 50 | service expenditures for comparable groups of Medicaid |
| 51 | recipients based on the provisions of this section. |
