6An act relating to police dogs, fire dogs, SAR dogs, and
7police horses; amending s. 843.19, F.S.; prohibiting
8intentionally and knowingly, without justification,
9causing great bodily harm to or using a deadly weapon upon
10a police dog, fire dog, SAR dog, or police horse;
11prohibiting actually and intentionally maliciously
12touching, striking, or causing bodily harm to a police
13dog, fire dog, SAR dog, or police horse; prohibiting
14maliciously harassing, teasing, interfering with, or
15attempting to interfere with a police dog, fire dog, SAR
16dog, or police horse while the animal is in the
17performance of its duties; providing penalties; providing
18for restitution from violators; providing application;
19providing an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Subsection (2) of section 843.19, Florida
24Statutes, is amended, and subsections (3), (4), and (5) are
25added to said section, to read:
26     843.19  Offenses against Injuring or killing police dogs
27dog, fire dogs dog, SAR dogs dog, or police horses horse
28prohibited; penalty.--
29     (2)  Any person who intentionally and knowingly, and
30willfully and without lawful cause or justification, causes
31great inflicts bodily harm, permanent disability, or death to,
32or uses a deadly weapon upon, a police dog, fire dog, SAR dog,
33or police horse commits a felony of the third degree, punishable
34as provided in s. 775.082, s. 775.083, or s. 775.084.
35     (3)  Any person who actually and intentionally maliciously
36touches, strikes, or causes bodily harm to a police dog, fire
37dog, SAR dog, or police horse commits a misdemeanor of the first
38degree, punishable as provided in s. 775.082 or s. 775.083.
39     (4)  Any person who intentionally or knowingly maliciously
40harasses, teases, interferes with, or attempts to interfere with
41a police dog, fire dog, SAR dog, or police horse while the
42animal is in the performance of its duties commits a misdemeanor
43of the second degree, punishable as provided in s. 775.082 or s.
44775.083.
45     (5)  A person convicted of an offense under this section
46shall make restitution for injuries caused to the police dog,
47fire dog, SAR dog, or police horse and shall pay the replacement
48cost of the animal if, as a result of the offense, the animal
49can no longer perform its duties.
50     Section 2.  This act shall take effect October 1, 2005, and
51shall apply to offenses occurring on or after that date.
