  1                      A bill to be entitled

  2         An act relating to community residential homes;

  3         amending s. 419.001, F.S.; requiring that a

  4         local government approve the location of

  5         certain community residential homes; providing

  6         an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (2) of section 419.001, Florida

11  Statutes, is amended to read:

12         419.001  Site selection of community residential

13  homes.--

14         (2)  Homes of six or fewer residents which otherwise

15  meet the definition of a community residential home shall be

16  deemed a single-family unit and a noncommercial, residential

17  use for the purpose of local laws and ordinances. Homes of six

18  or fewer residents which otherwise meet the definition of a

19  community residential home shall be allowed in single-family

20  or multifamily zoning with without approval by the local

21  government, provided that such homes shall not be located

22  within a radius of 1,000 feet of another existing such home

23  with six or fewer residents. Such homes with six or fewer

24  residents shall not be required to comply with the

25  notification provisions of this section; provided, however,

26  that the sponsoring agency or the department notifies the

27  local government at the time of home occupancy that the home

28  is licensed by the department.

29         Section 2.  This act shall take effect July 1, 2005.
