  1                      A bill to be entitled
  2         An act relating to educational facilities;
  3         creating s. 1013.135, F.S.; requiring each
  4         district school board to adopt and implement an
  5         indoor air quality program; requiring annual
  6         reports to the Department of Education;
  7         requiring uniform air quality inspections and
  8         evaluations; providing requirements for
  9         educational facility sites and project plans;
10         providing requirements for heating,
11         ventilating, and air-conditioning systems;
12         requiring maintenance of records; requiring
13         school district or educational facility indoor
14         air quality committees; requiring indoor
15         environmental quality training programs for
16         staff; providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:
19  
20         Section 1.  Section 1013.135, Florida Statutes, is
21  created to read:
22         1013.135  Indoor air quality of educational
23  facilities.--
24         (1)  Each district school board shall adopt and
25  implement an indoor air quality program using the guidelines
26  of the United States Environmental Protection Agency's Indoor
27  Air Quality Tools for Schools Program to provide for ongoing
28  maintenance and facility reviews necessary for the improvement
29  and proper maintenance of the indoor air quality of its
30  educational facilities.

 1         (2)  Each district school board shall annually report
 2  to the Department of Education on the condition of the air
 3  quality of its educational facilities and the action taken to
 4  implement its indoor air quality program and long-range
 5  building program through the district educational facilities
 6  plan and district facilities work program.
 7         (3)  Before January 2010 and every 5 years thereafter,
 8  each district school board shall conduct a uniform air quality
 9  inspection and evaluation of its educational facilities built
10  or renovated after January 1, 2005, using the United States
11  Environmental Protection Agency's Indoor Air Quality Tools for
12  Schools Kit. Educational facilities built before January 1,
13  2005, which are not scheduled for renovation are subject to
14  such inspection and evaluation every 2 years beginning with
15  the implementation of the school district's indoor air quality
16  program. A district school board conducting an inspection and
17  evaluation under this subsection shall make available for
18  public inspection at a regularly scheduled district school
19  board meeting the results of the inspection and evaluation.
20         (4)  Prior to approval for new construction, a district
21  school board shall provide for an environmental site
22  assessment relating to air quality pursuant to s. 1013.365. A
23  district school board may not approve an educational facility
24  site or project plan if:
25         (a)  The site is in an area of moderate or high radon
26  potential, unless the project plan incorporates construction
27  techniques to mitigate radon levels in the air of the
28  facility; or
29         (b)  The standards of the State Uniform Building Code
30  for Educational Facilities Construction for heating,
31  ventilating, and air-conditioning systems are not met.

 1         (5)  Each district school board shall ensure that the
 2  heating, ventilating, and air-conditioning systems of each of
 3  its educational facilities are:
 4         (a)  Maintained and operated in accordance with the
 5  prevailing maintenance standards, such as the standards of the
 6  American Society of Heating, Refrigerating and
 7  Air-Conditioning Engineers (ASHRAE), at the time of
 8  installation or renovation of the system.
 9         (b)  Operated continuously during the hours that
10  students or school personnel occupy the facilities except
11  during scheduled maintenance and emergency repairs or during
12  periods for which school officials can demonstrate to the
13  department's satisfaction that the quantity of outdoor air
14  supplied by an air supply system that is not mechanically
15  driven meets the ASHRAE standards for air changes per hour.
16         (6)  Each district school board shall maintain records
17  of the maintenance of its heating, ventilating, and
18  air-conditioning systems for at least 5 years.
19         (7)  Each district school board shall establish an
20  indoor air quality committee for the school district or for
21  each facility using the guidelines established by the United
22  States Environmental Protection Agency's Indoor Air Quality
23  Tools for Schools Program to increase staff and student
24  awareness of facets of the environment which may affect the
25  health of the occupants of the facilities, including, but not
26  limited to, air quality and the presence of radon.
27         (8)  Each district school board shall develop an indoor
28  environmental quality training program for facilities,
29  maintenance, and custodial staff. New employees must complete
30  the training program within the first 60 days following
31  employment. Existing employees must complete the training

 1  program within 1 year after the implementation of the program.
 2  In the case of new construction, extension, renovation, or
 3  replacement of an educational facility, building maintenance
 4  staff responsible for the facility must be trained, or must be
 5  receiving training, in the appropriate areas of plant
 6  operations, including, but not limited to, heating,
 7  ventilating, and air-conditioning systems. Such training must
 8  be incorporated in the current training manual for
 9  certification of master custodians.
10         Section 2.  This act shall take effect July 1, 2005.
