| 4 | On page 2, between lines 24 and 25, insert: |
| 5 | Section 1. Subsection (2) of section 627.638, Florida |
| 6 | Statutes, is amended to read: |
| 7 | 627.638 Direct payment for hospital, medical services.-- |
| 8 | (2) Whenever, in any health insurance claim form, an |
| 9 | insured specifically authorizes payment of benefits directly to |
| 10 | any recognized hospital, or physician, or dentist, the insurer |
| 11 | shall make such payment to the designated provider of such |
| 12 | services, unless otherwise provided in the insurance contract. |
| 13 | The insurance contract may not prohibit, and claims forms must |
| 14 | provide option for, the payment of benefits directly to a |
| 15 | licensed hospital, physician, and dentist for care provided |
| 16 | pursuant to s. 395.1041. The insurer may require written |
| 17 | attestation of assignment of benefits. Payment to the provider |
| 18 | from the insurer shall be no more than the amount that the |
| 19 | insurer would otherwise have paid without the assignment. |
