  2         An act relating to lewdness; amending s.

  3         796.07, F.S.; redefining the term "lewdness"

  4         for purposes of provisions that prohibit and

  5         provide penalties for prostitution, lewdness,

  6         or assignation; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Paragraph (b) of subsection (1) of section

11  796.07, Florida Statutes, is amended to read:

12         796.07  Prohibiting prostitution, etc.; evidence;

13  penalties; definitions.--

14         (1)  As used in this section:

15         (b)  "Lewdness" means any indecent or obscene act that

16  may cause substantial offense to one or more persons viewing

17  it or may otherwise substantially intrude upon the rights of

18  others. A lewd act may be offensive to, or may intrude upon

19  the rights of, a person who is a law enforcement officer.

20  Lewdness is to be determined based on what a reasonable member

21  of the public might find substantially offensive.

22         Section 2.  This act shall take effect July 1, 2005.
