| 8 | to locate persons to whom collections or refunds are owed |
| 9 | prior to determining a collection or refund to be |
| 10 | undistributable; providing for disclosure of information |
| 11 | on the Internet; providing for protection of the privacy |
| 12 | of persons named in the database; providing an effective |
| 13 | date. |

| 15 | Be It Enacted by the Legislature of the State of Florida: |
| 16 |

| 17 | Section 1. Paragraph (a) of subsection (2) of section |
| 18 | 409.2558, Florida Statutes, is amended to read: |
| 19 | 409.2558 Support distribution and disbursement.-- |
| 20 | (2) UNDISTRIBUTABLE COLLECTIONS.-- |
| 21 | (a) The department shall establish by rule the method for |
| 22 | determining a collection or refund to a noncustodial parent to |
| 23 | be undistributable to the final intended recipient. Before |
| 24 | determining a collection or refund to be undistributable, the |
| 25 | department shall make reasonable efforts to locate persons to |
| 26 | whom collections or refunds are owed so that payment can be |
| 27 | made. Location efforts may include disclosure through a |
| 28 | searchable database of the names of obligees, obligors, and |
| 29 | depository account numbers on the Internet employing appropriate |
| 30 | safeguards to protect the privacy of the persons named in the |
| 31 | database. |
| 32 | Section 2. This act shall take effect July 1, 2005. |
