3     Amendment to Senate Amendment (172566) (with title
4amendment)
5     On page 2, line 19, insert:
6     Section 5.  Subsections (6) and (7) are added to section
7401.107, Florida Statutes, to read:
8     401.107  Definitions.--As used in this part, the term:
9     (6)  "Youth athletic organization" means a private
10not-for-profit organization that promotes and provides organized
11athletic activities to youth.
12     (7)  "Automated external defibrillator device" means a
13device as defined in s. 768.1325(2)(b).
14     Section 6.  Section 401.111, Florida Statutes, is amended
15to read:
16     401.111  Emergency medical services grant program;
17authority.--The department is hereby authorized to make grants
18to local agencies, and emergency medical services organizations,
19and youth athletic organizations in accordance with any
20agreement entered into pursuant to this part. These grants shall
21be designed to assist local said agencies and emergency medical
22services organizations in providing emergency medical services,
23including emergency medical dispatch, and to assist youth
24athletic organizations that work in conjunction with local
25emergency medical services organizations to expand the use of
26automated external defibrillator devices in the community. The
27cost of administering this program shall be paid by the
28department from funds appropriated to it.
29     Section 7.  Paragraphs (a) and (b) of subsection (2) of
30section 401.113, Florida Statutes, are amended to read:
31     401.113  Department; powers and duties.--
32     (2)  The department shall annually dispense funds contained
33in the Emergency Medical Services Trust Fund as follows:
34     (a)  Forty-five percent of such moneys must be divided
35among the counties according to the proportion of the combined
36amount deposited in the trust fund from the county. These funds
37may not be used to match grant funds as identified in paragraph
38(b). An individual board of county commissioners may distribute
39these funds to emergency medical service organizations and youth
40athletic organizations within the county, as it deems
41appropriate.
42     (b)  Forty percent of such moneys must be used by the
43department for making matching grants to local agencies,
44municipalities, and emergency medical services organizations,
45and youth athletic organizations for the purpose of conducting
46research, increasing existing levels of emergency medical
47services, evaluation, community education, injury-prevention
48programs, and training in cardiopulmonary resuscitation and
49other lifesaving and first aid techniques.
50     1.  At least 90 percent of these moneys must be made
51available on a cash matching basis. A grant made under this
52subparagraph must be contingent upon the recipient providing a
53cash sum equal to 25 percent of the total department-approved
54grant amount.
55     2.  No more than 10 percent of these moneys must be made
56available to rural emergency medical services, and
57notwithstanding the restrictions specified in subsection (1),
58these moneys may be used for improvement, expansion, or
59continuation of services provided. A grant made under this
60subparagraph must be contingent upon the recipient providing a
61cash sum equal to no more than 10 percent of the total
62department-approved grant amount.

64The department shall develop procedures and standards for grant
65disbursement under this paragraph based on the need for
66emergency medical services, the requirements of the population
67to be served, and the objectives of the state emergency medical
68services plan.
69     Section 8.  The Department of Health shall implement an
70educational campaign to inform any person who acquires an
71automated external defibrillator device that his or her immunity
72from liability under s. 768.1325, Florida Statutes, for harm
73resulting from the use or attempted use of the device, does not
74apply if he or she fails to:
75     (1)  Properly maintain and test the device; or
76     (2)  Provide appropriate training in the use of the device
77to his or her employee or agent when the employee or agent was
78the person who used the device on the victim, except as provided
79in s. 768.1325, Florida Statutes.

105organization" and "automated external defibrillator device";
106amending s. 401.111, F.S.; providing for grants to local
107agencies, emergency medical services organizations, and youth
108athletic organizations to expand the use of automated external
109defibrillator devices; amending s. 401.113, F.S.; providing for
110disbursement of funds from the Emergency Medical Services Trust
111Fund; requiring the Department of Health to implement an
112educational campaign to inform the public about the lack of
113immunity from liability regarding the use of automated external
114defibrillator devices under certain conditions;
