| 5 | (3)(a) Effective May 2, 2005, employers shall pay |
| 6 | employees a minimum wage at an hourly rate of $6.15 for all |
| 7 | hours worked in Florida. Only those individuals entitled to |
| 8 | receive the federal minimum wage under the federal Fair Labor |
| 9 | Standards Act and its implementing regulations shall be eligible |
| 10 | to receive the state minimum wage pursuant to s. 24, Art. X of |
| 11 | the State Constitution and this section. The provisions of ss. |
| 12 | 213 and 214 of the federal Fair Labor Standards Act, as |
| 13 | interpreted by applicable federal regulations and implemented by |
| 14 | the Secretary of Labor, are incorporated herein. |
| 15 | (b) Employers required to pay the state minimum wage as |
| 16 | provided for in paragraph (a) shall post notice of the |
| 17 | applicable wage in certain locations as required under federal |
| 18 | law. If authorized under federal law, employers may post a |
| 19 | single notice designed to inform employees of both the federal |
| 20 | and applicable state minimum wage rate. |
