14 On page 9, between lines 22 and 23,
15
16 insert: 551.1035 Emergency rules.--
17 (1) The division shall prepare and implement emergency
18 rules necessary to permit the operation of slot machine gaming
19 at eligible facilities within 90 days after effective date of
20 this act.
21 (2) Notwithstanding any provision of law to the
22 contrary, each existing eligible facility shall be permitted
23 to conduct slot machine gaming operations on the premises
24 described in its pari-mutuel permit no later than 120 days
25 after the effective date of this act, provided such eligible
26 facility's permit to conduct pari-mutuel wagering is in good
27 standing and the eligible facility's ownership interests have
28 been previously approved as provided in chapter 550 and
29 provided the eligible facility has implemented a comprehensive
30 system of internal controls with respect to its operations,
31 security, and surveillance. The eligible facility shall be

1 allowed to conduct slot machine gaming operations until such
2 time as permanent rules and forms have been adopted and the
3 eligible facility has been provided a reasonable opportunity
4 to comply with them. Furthermore, such eligible facility shall
5 not be allowed to conduct slot machine gaming operations until
6 such time as it has made payment of the initial license fee.
7 (3) Notwithstanding any provision of law to the
8 contrary, a manufacturer or distributor of slot machines that
9 holds a valid gaming license in any other state may act as a
10 manufacturer or distributor of slot machines as provided in
11 this chapter, and may sell slot machines that are approved for
12 use in another state, upon the effective date of this act
13 until such time as permanent rules and forms have been adopted
14 and such manufacturer or distributor has been provided a
15 reasonable opportunity to comply with them.
16 (4) If there is any challenge to any rule adopted by
17 the division under this section, the licensee may continue to
18 operate under the provisions of this act, notwithstanding the
19 rule challenge.
