2 An act relating to a review under the Open
3 Government Sunset Review Act; amending s.
4 267.135, F.S., relating to a public-records
5 exemption for information identifying the
6 location of an archaeological site which is
7 contained in records of the Division of
8 Historical Resources of the Department of
9 State; saving the exemption from repeal under
10 the Open Government Sunset Review Act; deleting
11 provisions providing for the repeal of the
12 exemption; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 267.135, Florida Statutes, is
17 amended to read:
18 267.135 Location of archaeological sites.--Any
19 information identifying the location of an archaeological site
20 which is held sites contained in site files or other records
21 maintained by the Division of Historical Resources of the
22 Department of State is exempt from the provisions of s.
23 119.07(1) and s. 24(a) of Art. I of the State Constitution, if
24 the Division of Historical Resources finds that disclosure of
25 such information will create a substantial risk of harm,
26 theft, or destruction at such site sites. This section is
27 subject to the Open Government Sunset Review Act in accordance
28 with s. 119.15 and expires on October 2, 2006, unless reviewed
29 and reenacted by the Legislature.
30 Section 2. This act shall take effect October 1, 2006.
