9developmental disabilities; requiring the Dan Marino
10Foundation, Inc., to develop certification requirements
11and a training curriculum and to submit the certification
12requirements to the Department of Health for review;
13providing deadlines for certification; amending s.
14514.075, F.S.; deleting an exception to the requirement
15that a public pool be serviced by a certified technician;
16providing a contingent effective date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Section 514.072, Florida Statutes, is created
21to read:
22     514.072  Certification of swimming instructors for people
23who have developmental disabilities required.--Any person
24working at a swimming pool who holds himself or herself out as a
25swimming instructor specializing in training people who have
26developmental disabilities, as defined in s. 393.063(10), may be
27certified by the Dan Marino Foundation, Inc., in addition to
28being certified under s. 514.071. The Dan Marino Foundation,
29Inc., must develop certification requirements and a training
30curriculum for swimming instructors for people who have
31developmental disabilities and must submit the certification
32requirements to the Department of Health for review by January
331, 2007. A person certified under s. 514.071 before July 1,
342007, must meet the additional certification requirements of
35this section before January 1, 2008. A person certified under s.
36514.071 on or after July 1, 2007, must meet the additional
37certification requirements of this section within 6 months after
38receiving certification under s. 514.071.
39     Section 2.  Section 514.075, Florida Statutes, is amended
40to read:
41     514.075  Public pool service technician;
42certification.--The department may require that a public pool,
43as defined in s. 514.011, be serviced by a person certified as a
44pool service technician. To be certified, an individual must
45demonstrate knowledge of public pools which includes, but is not
46limited to: pool cleaning; general pool maintenance; source of
47the water supply; bacteriological, chemical, and physical
48quality of water; and water purification, testing, treatment,
49and disinfection procedures. The department may, by rule,
50establish the requirement for the certification course and
51course approval. The department shall deem certified any
52individual who is certified by a course of national recognition
53or any person licensed under s. 489.105(3)(j), (k), or (l). This
54requirement does not apply to a person, or the direct employee
55of a person, permitted as a public pool operator under s.
56514.031.
57     Section 3.  This act shall take effect July 1, 2006, only
58if a specific appropriation to the Department of Health to fund
59the Dan Marino Foundation, Inc., is made in the General
60Appropriations Act for fiscal year 2006-2007.
