1	A bill to be entitled
2	An act relating to swimming instructors; creating s.
3	514.072, F.S.; requiring additional certification of
4	swimming instructors specializing in training people who
5	have developmental disabilities; requiring the Dan Marino
6	Foundation, Inc., to develop certification requirements
7	and a training curriculum and to submit the certification
8	requirements to the Department of Health for review;
9	providing deadlines for certification; providing a
10	contingent effective date.

12	Be It Enacted by the Legislature of the State of Florida:
13
14	Section 1.  Section 514.072, Florida Statutes, is created
15	to read:
16	514.072  Certification of swimming instructors for people
17	who have developmental disabilities required.--Any person
18	working at a swimming pool who holds himself or herself out as a
19	swimming instructor specializing in training people who have
20	developmental disabilities, as defined in s. 393.063(10), may be
21	certified by the Dan Marino Foundation, Inc., in addition to
22	being certified under s. 514.071. The Dan Marino Foundation,
23	Inc., must develop certification requirements and a training
24	curriculum for swimming instructors for people who have
25	developmental disabilities and must submit the certification
26	requirements to the Department of Health for review by January
27	1, 2007. A person certified under s. 514.071 before July 1,
28	2007, must meet the additional certification requirements of
29	this section before January 1, 2008. A person certified under s.
30	514.071 on or after July 1, 2007, must meet the additional
31	certification requirements of this section within 6 months after
32	receiving certification under s. 514.071.
33	Section 2.  This act shall take effect July 1, 2006, only
34	if a specific appropriation to the Department of Health to fund
35	the Dan Marino Foundation, Inc., is made in the General
36	Appropriations Act for fiscal year 2006-2007.
