  1                      A bill to be entitled
  2         An act relating to the protection of water
  3         quality in the Wekiva Study Area; amending s.
  4         369.318, F.S.; requiring the Department of
  5         Agriculture and Consumer Services, in
  6         conjunction with the Institute of Food and
  7         Agricultural Sciences at the University of
  8         Florida, to facilitate certain recommendations
  9         for the use of fertilizer within the Wekiva
10         Study Area; requiring that the recommendations
11         be provided to the Department of Environmental
12         Protection for incorporation into certain best
13         management practices for a nonagricultural,
14         nonpoint source of pollution; providing an
15         effective date.

17  Be It Enacted by the Legislature of the State of Florida:

19         Section 1.  Subsection (9) of section 369.318, Florida
20  Statutes, is amended to read:
21         369.318  Studies.--
22         (9)  The Department of Agriculture and Consumer
23  Services shall be the lead agency in coordinating the
24  reduction of agricultural nonpoint sources of pollution. The
25  Department of Agriculture and Consumer Services shall study,
26  and if necessary, initiate rulemaking to implement new or
27  revised best management practices for improving and protecting
28  water bodies, including those basins with impaired water
29  bodies addressed by the Total Maximum Daily Loads Program. The
30  Department of Agriculture and Consumer Services, in
31  conjunction with the Institute of Food and Agricultural

 1  Sciences at the University of Florida, shall facilitate the
 2  development of recommendations for using agronomically-based
 3  fertilizer for nonagricultural settings within the Wekiva
 4  Study Area which protect the quality of surface and ground
 5  water.  Information regarding such fertilizer recommendations
 6  shall be made available to the Department of Environmental
 7  Protection for incorporation into the best management
 8  practices for nonpoint sources developed pursuant to s.
 9  403.067(7)(c)1. for the Wekiva Study Area.
10         Section 2.  This act shall take effect July 1, 2006.

13                          SENATE SUMMARY
14    Directs the Department of Agriculture and Consumer
      Services, in conjunction with the Institute of Food and
15    Agricultural Sciences at the University of Florida, to
      facilitate certain fertilizer recommendations for the
16    Wekiva Study Area in order to protect water quality.
      Authorizes provision of information regarding such
17    recommendations to the Department of Environmental
      Protection for incorporation into certain best management
18    practices for a nonagricultural, nonpoint source of water
      pollution.
