1	A bill to be entitled
2	An act relating to the North Naples Fire Control and
3	Rescue District, Collier County; amending chapter 99-450,
4	Laws of Florida; providing for the payment of certain
5	taxes and fees and the application of certain regulations
6	and requirements in the event of annexation by a
7	municipality within the boundaries of the district;
8	providing an effective date.

10	Be It Enacted by the Legislature of the State of Florida:

12	Section 1.  Section 3 of Article III of section 3 of
13	chapter 99-450, Laws of Florida, is amended to read:
14	ARTICLE III
15	Boundaries of the District
16	Section 3.  Section 171.093, Florida Statutes, applies to
17	annexations by a municipality within the boundaries of the
18	district. The annexing municipality shall annually pay the
19	district the equivalent of the premium tax revenues authorized
20	in sections 175.041 and 175.101, Florida Statutes, that are
21	attributable to the annexed properties during the duration and
22	until the later of the expiration of the period provided for in
23	section 171.093(4), Florida Statutes, or the expiration of the
24	interlocal agreement, or any extension of such agreement, as
25	authorized in section 171.093(3), Florida Statutes. During the
26	term of the district's provision of fire protection services to
27	the annexed area, the district's regulations, inspection
28	requirements, and authority to collect inspection fees and
29	impact fees shall apply within the annexed area. In the event
30	that property in the district is annexed by the City of Naples
31	between January 1 and July 1 of any year, the property shall be
32	regarded as removed from the North Naples Fire Control and
33	Rescue District as of January 1 of that year for the purpose of
34	the levy of general ad valorem taxes by the district. If
35	annexation occurs after July 1, the property shall be assessed
36	by the district for ad valorem taxes for that year. On and after
37	the effective date of annexation, the district shall be relieved
38	of providing fire service to the annexed area. The city and the
39	district may reach an agreement to determine what portion, if
40	any, of the existing indebtedness or property of the district
41	shall be assumed by the municipality of which the annexed
42	territory will become a part, the fair value of such
43	indebtedness or property, and the manner of transfer and
44	financing. Nothing herein shall relieve the property annexed
45	from the payment of general obligation debt service incurred by
46	the district before annexation.
47	Section 2.  This act shall take effect upon becoming a law.
