| 7 | An act relating to the Division of Emergency Management of | 
| 8 | the Department of Community Affairs; amending s. 20.18, | 
| 9 | F.S.; providing that the director of the Division of | 
| 10 | Emergency Management be designated as agency head of the | 
| 11 | division; providing for appointment of the director by the | 
| 12 | Governor; providing that the division is a separate budget | 
| 13 | entity, not subject to control by the department; | 
| 14 | providing for an agreement between the division and | 
| 15 | department for certain services; prescribing duties of the | 
| 16 | division; providing an effective date. |

| 18 | Be It Enacted by the Legislature of the State of Florida: | 
| 19 | 
 | 
| 20 | Section 1.  Paragraph (a) of subsection (2) of section | 
| 21 | 20.18, Florida Statutes, is amended to read: | 
| 22 | 20.18  Department of Community Affairs.--There is created a | 
| 23 | Department of Community Affairs. | 
| 24 | (2)  The following units of the Department of Community | 
| 25 | Affairs are established: | 
| 26 | (a)  Division of Emergency Management. The division is a | 
| 27 | separate budget entity and is not subject to control, | 
| 28 | supervision, or direction by the Department of Community Affairs | 
| 29 | in any manner, including, but not limited to, personnel, | 
| 30 | purchasing, transactions involving personal property, and | 
| 31 | budgetary matters. The division director shall be appointed by | 
| 32 | the Governor, shall serve at the pleasure of the Governor, and | 
| 33 | shall be the agency head of the division for all purposes. The | 
| 34 | division shall enter into a service agreement with the | 
| 35 | department for professional, technological, and administrative | 
| 36 | support services. The division shall collaborate and coordinate | 
| 37 | with the department on nonemergency response matters, including, | 
| 38 | but not limited to, disaster recovery programs, grant programs, | 
| 39 | mitigation programs, and emergency matters related to | 
| 40 | comprehensive plans. | 
| 41 | Section 2.  This act shall take effect July 1, 2006. |
