4     Between lines 74 and 75 insert:
5     Section 2.  Except for entities to which the provisions of
6s. 768.28, Florida Statutes, apply, notwithstanding any other
7provision of law, a person, as defined in s. 1.01, Florida
8Statutes, is not immune and may not be presumed immune from
9civil liability for damages arising from the person's
10negligence. For purposes of this section, the term "negligence"
11includes wrongful acts or omissions based upon theories of
12negligence, strict liability, products liability, professional
13malpractice, whether couched in terms of tort or contract, or
14breach of warranty and similar theories.
