A bill to be entitled
2An act relating to insurer rate filing obligations;
3amending s. 627.091, F.S.; deleting an alternative
4authorization for insurers to satisfy certain rate filing
5obligations; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Subsections (4), (5), and (6) of section
10627.091, Florida Statutes, are amended to read:
11     627.091  Rate filings; workers' compensation and employer's
12liability insurances.--
13     (4)  An insurer may satisfy its obligation to make such
14filings by becoming a member of, or a subscriber to, a licensed
15rating organization which makes such filings and by authorizing
16the office to accept such filings in its behalf; but nothing
17contained in this chapter shall be construed as requiring any
18insurer to become a member or a subscriber to any rating
19organization.
20     (4)(5)  Pursuant to the provisions of s. 624.3161, the
21office may examine the underlying statistical data used in such
22filings.
23     (5)(6)  Whenever the committee of a recognized rating
24organization with responsibility for workers' compensation and
25employer's liability insurance rates in this state meets to
26discuss the necessity for, or a request for, Florida rate
27increases or decreases, the determination of Florida rates, the
28rates to be requested, and any other matters pertaining
29specifically and directly to such Florida rates, such meetings
30shall be held in this state and shall be subject to s. 286.011.
31The committee of such a rating organization shall provide at
32least 3 weeks' prior notice of such meetings to the office and
33shall provide at least 14 days' prior notice of such meetings to
34the public by publication in the Florida Administrative Weekly.
35     Section 2.  This act shall take effect July 1, 2006.
