2An act relating to specialty license plates; amending s.
3320.08056, F.S.; revising specialty license plate use fee
4provisions to change a name; establishing an annual use
5fee for the Homeownership For All license plate; exempting
6collegiate license plates from discontinuance
7requirements; amending s. 320.08058, F.S.; revising
8authorized uses of the use fees received from sales of the
9Keep Kids Drug-Free license plate; changing the name of
10the Florida Memorial College license plate to the Florida
11Memorial University license plate; revising authorized
12uses of the use fees received from sales of the
13Sportsmen's National Land Trust license plate; creating
14the Homeownership For All license plate and providing for
15distribution of the fees received from sales of the plate;
16amending s. 320.0807, F.S.; creating special license
17plates for legislative presiding officers; providing an
18effective date.

20Be It Enacted by the Legislature of the State of Florida:
21
22     Section 1.  Paragraph (z) of subsection (4) and paragraph
23(a) of subsection (8) of section 320.08056, Florida Statutes,
24are amended, and paragraph (eee) is added to subsection (4) of
25that section, to read:
26     320.08056  Specialty license plates.--
27     (4)  The following license plate annual use fees shall be
28collected for the appropriate specialty license plates:
29     (z)  Florida Memorial University College license plate,
30$25.
31     (eee)  Homeownership For All license plate, $25.
32     (8)(a)  The department must discontinue the issuance of an
33approved specialty license plate if the number of valid
34specialty plate registrations falls below 1,000 plates for at
35least 12 consecutive months. A warning letter shall be mailed to
36the sponsoring organization following the first month in which
37the total number of valid specialty plate registrations is below
381,000 plates. The provisions of this subsection do not apply to
39collegiate license plates established pursuant to s.
40320.08058(3).
41     Section 2.  Subsections (23), (26), and (48) of section
42320.08058, Florida Statutes, are amended, and subsection (57) is
43added to that section, to read:
44     320.08058  Specialty license plates.--
45     (23)  KEEP KIDS DRUG-FREE LICENSE PLATES.--
46     (a)  The department shall develop a Keep Kids Drug-Free
47license plate as provided in this section. The word "Florida"
48must appear at the top of the plate, and the words "Keep Kids
49Drug-Free" must appear at the bottom of the plate.
50     (b)  The annual use fees shall be distributed to the Keep
51Kids Drug-Free Foundation, Inc., which shall use the fees to
52fund activities to reduce substance abuse among residents of
53this state. The foundation shall develop a plan to distribute
54the funds for drug-abuse prevention programs.
55     (c)  Notwithstanding s. 320.08062, up to 10 percent of the
56proceeds from the annual use fee may be used for marketing the
57Keep Kids Drug-Free license plate and for administrative costs
58directly related to the management and distribution of the
59proceeds.
60     (26)  FLORIDA MEMORIAL UNIVERSITY COLLEGE LICENSE PLATES.--
61     (a)  The department shall develop a Florida Memorial
62University College license plate as provided in this section.
63The word "Florida" must appear at the top of the plate, and the
64words "Florida Memorial University College" must appear at the
65bottom of the plate.
66     (b)  The annual use fees shall be distributed to Florida
67Memorial University College.
68     (48)  SPORTSMEN'S NATIONAL LAND TRUST LICENSE PLATES.--
69     (a)  The department shall develop a Sportsmen's National
70Land Trust license plate as provided in this section. The word
71"Florida" must appear at the top of the plate, and the words
72"Sportsmen's National Land Trust" must appear at the bottom of
73the plate.
74     (b)  The annual revenues from the sales of the license
75plate shall be distributed to the Sportsmen's National Land
76Trust. Such annual revenues must be used by the trust in the
77following manner:
78     1.  Fifty percent may be retained until fifty percent of
79all startup costs for developing and establishing the plate have
80been recovered.
81     2.  Twenty-five percent must be used to fund programs and
82projects within the state that preserve open space and wildlife
83habitat, promote conservation, improve wildlife habitat, and
84establish open space for the perpetual use of the public.
85     3.  Twenty-five percent may be used for promotion,
86marketing, and administrative costs directly associated with
87operation of the trust.
88     (c)  When the provisions of subparagraph (b)1. are met,
89those annual revenues shall be used for the purposes of
90subparagraph (b)2.
91     (57)  HOMEOWNERSHIP FOR ALL LICENSE PLATES.--
92     (a)  The department shall develop a Homeownership For All
93license plate as provided in this section. The word "Florida"
94must appear at the top of the plate, and the words "Support
95Homeownership For All" must appear at the bottom of the plate.
96     (b)  The annual use fees shall be distributed to
97Homeownership For All, Inc., which may use a maximum of 10
98percent of the proceeds to promote and market the plate. The
99remainder of the proceeds shall be used by Homeownership For
100All, Inc., to fund programs that provide, promote, or otherwise
101support affordable housing in this state.
102     Section 3.  Subsection (5) of section 320.0807, Florida
103Statutes, is renumbered as subsection (6), and a new subsection
104(5) is added to that section to read:
105     320.0807  Special license plates for Governor and federal
106and state legislators.--
107     (5)  Upon application by any current or former President of
108the Senate and payment of the fees prescribed by s. 320.0805,
109the department is authorized to issue a license plate stamped in
110bold letters "Senate President" followed by the number assigned
111by the department or chosen by the applicant if it is not
112already in use. Upon application by any current or former
113Speaker of the House of Representatives and payment of the fees
114prescribed by s. 320.0805, the department is authorized to issue
115a license plate stamped in bold letters "House Speaker" followed
116by the number assigned by the department or chosen by the
117applicant if it is not already in use.
118     Section 4.  This act shall take effect July 1, 2006.
