2An act relating to specialty license plates; amending s.
3320.08056, F.S.; revising specialty license plate use fee
4provisions to change a name; establishing an annual use
5fee for the Homeownership For All license plate; exempting
6collegiate license plates from discontinuance
7requirements; amending s. 320.08058, F.S.; revising
8authorized uses of the use fees received from sales of the
9Keep Kids Drug-Free license plate; changing the name of
10the Florida Memorial College license plate to the Florida
11Memorial University license plate; revising authorized
12uses of the use fees received from sales of the
13Sportsmen's National Land Trust license plate; creating
14the Homeownership For All license plate and providing for
15distribution of the fees received from sales of the plate;
16amending s. 320.0807, F.S.; creating special license
17plates for legislative presiding officers; amending s.
18320.08056, F.S.; establishing an annual use fee for the
19Future Farmers of America license plate; amending s.
20320.08058, F.S.; creating the Future Farmers of America
21license plate and providing for use of funds received from
22the sale of the plates; providing an effective date.

24Be It Enacted by the Legislature of the State of Florida:
25
26     Section 1.  Paragraph (z) of subsection (4) and paragraph
27(a) of subsection (8) of section 320.08056, Florida Statutes,
28are amended, and paragraph (eee) is added to subsection (4) of
29that section, to read:
30     320.08056  Specialty license plates.--
31     (4)  The following license plate annual use fees shall be
32collected for the appropriate specialty license plates:
33     (z)  Florida Memorial University College license plate,
34$25.
35     (eee)  Homeownership For All license plate, $25.
36     (8)(a)  The department must discontinue the issuance of an
37approved specialty license plate if the number of valid
38specialty plate registrations falls below 1,000 plates for at
39least 12 consecutive months. A warning letter shall be mailed to
40the sponsoring organization following the first month in which
41the total number of valid specialty plate registrations is below
421,000 plates. The provisions of this subsection do not apply to
43collegiate license plates established pursuant to s.
44320.08058(3).
45     Section 2.  Subsections (23), (26), and (48) of section
46320.08058, Florida Statutes, are amended, and subsection (57) is
47added to that section, to read:
48     320.08058  Specialty license plates.--
49     (23)  KEEP KIDS DRUG-FREE LICENSE PLATES.--
50     (a)  The department shall develop a Keep Kids Drug-Free
51license plate as provided in this section. The word "Florida"
52must appear at the top of the plate, and the words "Keep Kids
53Drug-Free" must appear at the bottom of the plate.
54     (b)  The annual use fees shall be distributed to the Keep
55Kids Drug-Free Foundation, Inc., which shall use the fees to
56fund activities to reduce substance abuse among residents of
57this state. The foundation shall develop a plan to distribute
58the funds for drug-abuse prevention programs.
59     (c)  Notwithstanding s. 320.08062, up to 10 percent of the
60proceeds from the annual use fee may be used for marketing the
61Keep Kids Drug-Free license plate and for administrative costs
62directly related to the management and distribution of the
63proceeds.
64     (26)  FLORIDA MEMORIAL UNIVERSITY COLLEGE LICENSE PLATES.--
65     (a)  The department shall develop a Florida Memorial
66University College license plate as provided in this section.
67The word "Florida" must appear at the top of the plate, and the
68words "Florida Memorial University College" must appear at the
69bottom of the plate.
70     (b)  The annual use fees shall be distributed to Florida
71Memorial University College.
72     (48)  SPORTSMEN'S NATIONAL LAND TRUST LICENSE PLATES.--
73     (a)  The department shall develop a Sportsmen's National
74Land Trust license plate as provided in this section. The word
75"Florida" must appear at the top of the plate, and the words
76"Sportsmen's National Land Trust" must appear at the bottom of
77the plate.
78     (b)  The annual revenues from the sales of the license
79plate shall be distributed to the Sportsmen's National Land
80Trust. Such annual revenues must be used by the trust in the
81following manner:
82     1.  Fifty percent may be retained until fifty percent of
83all startup costs for developing and establishing the plate have
84been recovered.
85     2.  Twenty-five percent must be used to fund programs and
86projects within the state that preserve open space and wildlife
87habitat, promote conservation, improve wildlife habitat, and
88establish open space for the perpetual use of the public.
89     3.  Twenty-five percent may be used for promotion,
90marketing, and administrative costs directly associated with
91operation of the trust.
92     (c)  When the provisions of subparagraph (b)1. are met,
93those annual revenues shall be used for the purposes of
94subparagraph (b)2.
95     (57)  HOMEOWNERSHIP FOR ALL LICENSE PLATES.--
96     (a)  The department shall develop a Homeownership For All
97license plate as provided in this section. The word "Florida"
98must appear at the top of the plate, and the words "Support
99Homeownership For All" must appear at the bottom of the plate.
100     (b)  The annual use fees shall be distributed to
101Homeownership For All, Inc., which may use a maximum of 10
102percent of the proceeds to promote and market the plate. The
103remainder of the proceeds shall be used by Homeownership For
104All, Inc., to fund programs that provide, promote, or otherwise
105support affordable housing in this state.
106     Section 3.  Subsection (5) of section 320.0807, Florida
107Statutes, is renumbered as subsection (6), and a new subsection
108(5) is added to that section to read:
109     320.0807  Special license plates for Governor and federal
110and state legislators.--
111     (5)  Upon application by any current or former President of
112the Senate and payment of the fees prescribed by s. 320.0805,
113the department is authorized to issue a license plate stamped in
114bold letters "Senate President" followed by the number assigned
115by the department or chosen by the applicant if it is not
116already in use. Upon application by any current or former
117Speaker of the House of Representatives and payment of the fees
118prescribed by s. 320.0805, the department is authorized to issue
119a license plate stamped in bold letters "House Speaker" followed
120by the number assigned by the department or chosen by the
121applicant if it is not already in use.
122     Section 4.  Paragraph (fff) is added to subsection (4) of
123section 320.08056, Florida Statutes, as amended by this act, to
124read:
125     320.08056  Specialty license plates.--
126     (4)  The following license plate annual use fees shall be
127collected for the appropriate specialty license plates:
128     (fff)  Future Farmers of America license plate, $25.
129     Section 5.  Subsection (58) is added to section 320.08058,
130Florida Statutes,, as amended by this act, to read:
131     320.08058  Specialty license plates.--
132     (58)  FUTURE FARMERS OF AMERICA LICENSE PLATES.--
133     (a)  Notwithstanding s. 320.08053, the department shall
134develop a Future Farmers of America license plate as provided in
135this section. Future Farmers of America license plates must bear
136the colors and design approved by the department. The word
137"Florida" must appear at the top of the plate, and the words
138"Agricultural Education" must appear at the bottom of the plate.
139     (b)  The license plate annual use fee shall be distributed
140quarterly to the Florida Future Farmers of America Foundation,
141Inc., to fund activities and services of the Future Farmers of
142America.
143     (c)  The Florida Future Farmers of America Foundation,
144Inc., shall retain all revenue from the annual use fees until
145all startup costs for developing and establishing the plates
146have been recovered. Thereafter, up to 10 percent of the annual
147use fee revenue may be used for administrative, handling, and
148disbursement expenses and up to 5 percent may be used for
149advertising and marketing costs. All remaining annual use fee
150revenue shall be used by the Florida Future Farmers of America
151Foundation, Inc., to fund its activities, programs, and
152projects, including, but not limited to, student and teacher
153leadership programs, the Foundation for Leadership Training
154Center, teacher recruitment and retention, and other special
155projects.
156     Section 6.  This act shall take effect July 1, 2006.
