| 9 | (6) Any person that is an affiliate of a licensed motor |
| 10 | vehicle service agreement company which is domiciled in this |
| 11 | state and which uses contractual liability insurance to qualify |
| 12 | with the requirements of s. 634.041 is exempt from application |
| 13 | of this part if the person does not issue, market, or cause to |
| 14 | be marketed motor vehicle service agreements to residents of |
| 15 | this state and does not administer motor vehicle service |
| 16 | agreements that were originally issued to residents of this |
| 17 | state. Any affiliated person operating from this state under |
| 18 | this subsection must use a licensed motor vehicle service |
| 19 | agreement company to administer all service agreements issued by |
| 20 | such person in other states. If the office determines, after |
| 21 | notice and opportunity for hearing in accordance with s. |
| 22 | 120.569, that a person's intentional business practices do not |
| 23 | comply with any part of the exemption requirements of this |
| 24 | subsection, the person shall be subject to this part. The motor |
| 25 | vehicle service agreement company shall be liable for all acts |
| 26 | of and responsible for all violations of this part by an |
| 27 | affiliated person operating from this state. |
